Restricted weapons cannot be transferred, even if legally owned, without special procedures. "Transferring" includes loaning. For example, if you possessed a legally-defined assault weapon in CA before the ban, you were given a window to register it. It is then legal for you to possess, but you cannot sell it and you can not loan it; others may shoot it only while you are physically present. You cannot even turn it in for repair unless the gunsmith has a specific AW license.

As long as (a) the weapon is legal, and (b) the person you're lending it to is legally entitled to possess it (old enough, not a felon, no domestic violence charges etc.) then you should be ok. There are some exceptions: in CA for example, a person must have a handgun safety card to be lent a handgun. I didn't know this myself until recently. So yes, it is wise to check your state and local laws.

You would want to keep an eye out for excessive wear of the lower receiver parts. In this case, the sear which catches the hammer after each shot wore out and allowed the hammer to fall without an additional pull of the trigger. This is quite rare and only seen in very worn weapons.

The ATF's stance, from what I can gather, is that he knew beforehand that the gun would do this, but did not get it fixed, and further more he explained to his friend how to do it.
