Martinez' that an organization could prohibited from access to university funds and resources if that organization did not sign on to the university non-discrimination policy. The US Military thus would not have access to Harvard resources if its policies were opposed to Harvard's non-discrim. policy about homosexuals.
Harvard is a private institution, thus they are not subsidized by the government like public institutions. Why then would the government be exempt from complying with the university's regulations?
Let's say you have a piece of property and post "no trespassing" signs all around it. You have set up a private regulation. Do you enforce the no trespassing provision on private citizens but allow government employees to enter your land as if you had posted no signs at all?
Actually, Harvard receives $300+ Million/year in federal aid. This is about 16% of its total operating budget, which is why between 2000-2002 it caved into the Air Force's demand for on campus recruiting, citing that the A.F threatened to have all federal aid cut from the school if it didn't. Private as it may be, the U.S military knows how to piss around its power, regardless of who's hurt and how.
I was not aware of the amount it received, thanks for informing me. The point still stands though: according to CLS v. Martinez, universities can refuse to provide money or resources (such as room availability, etc.) to groups that do not adhere to the university non-discrimination policies. Therefore, what Kagan did was constitutional (if not popular in some circles), and although Harvard caved previously, doesn't mean they ought to be expected to do so always.
Oh, and I agree with you. But because of the Solomon Amendment, if said university prohibits or limits the recruiting power of the military at the school, then by law all federal funds to said school, be it public or private, will be cut. Again, I agree with you on this, but, sadly, the law is the law.
If that is the law then so be it. Kagan took a principled stance even though doing so risked a source of funding for her university.

They get bonuses for steering recruits into certain MOS's. They are the used car saleman of our military, and should be banned from every school until they clean up the recruiting process. I FINALLY agree with this guy. These hearings are a joke. Just look at the republicans questions. Its pretty obvious that the GOBP want to go back to the early 1900's when women and minorities didn't have any rights. WHen white men ruled. Last week, the Supreme Court decided in 'CLS v. Martinez' that an organization could prohibited from access to university funds and resources if that organization did not sign on to the university non-discrimination policy. The US Military thus would not have access to Harvard resources if its policies were opposed to Harvard's non-discrim. policy about homosexuals.

Harvard is a private institution, thus they are not subsidized by the government like public institutions. Why then would the government be exempt from complying with the university's regulations?
Let's say you have a piece of property and post "no trespassing" signs all around it. You have set up a private regulation. Do you enforce the no trespassing provision on private citizens but allow government employees to enter your land as if you had posted no signs at all?

Actually, Harvard receives $300+ Million/year in federal aid. This is about 16% of its total operating budget, which is why between 2000-2002 it caved into the Air Force's demand for on campus recruiting, citing that the A.F threatened to have all federal aid cut from the school if it didn't. Private as it may be, the U.S military knows how to piss around its power, regardless of who's hurt and how.

I was not aware of the amount it received, thanks for informing me. The point still stands though: according to CLS v. Martinez, universities can refuse to provide money or resources (such as room availability, etc.) to groups that do not adhere to the university non-discrimination policies. Therefore, what Kagan did was constitutional (if not popular in some circles), and although Harvard caved previously, doesn't mean they ought to be expected to do so always.

Oh, and I agree with you. But because of the Solomon Amendment, if said university prohibits or limits the recruiting power of the military at the school, then by law all federal funds to said school, be it public or private, will be cut. Again, I agree with you on this, but, sadly, the law is the law.

I can tell you for a fact, that recruiters will lie to you and promise things they cannot provide. They will also sell you into an MOS that benefits THEM. They get bonuses for steering recruits into certain MOS's. They are the used car saleman of our military, and should be banned from every school until they clean up the recruiting process. I love the military, My whole family does, but Kagan was right.

If the ROTC's arent smart enough to know that they can enlist ANYWHERE and ANYTIME THEY want, maybe they shouldn't be allowed to join. Kagan barred the recruiters from recruiting on campus, I doubt someone that dreams of serving, can't figure out how to do it without a recruiter. Especially if they have been in the ROTC for awhile. My ASVAB was 96%. WOW, 124% AWESOME!

As for Kagan being anti-military...try reading some of her 2005 briefs on the issue before charging blindly into "she's this" or "she's that" stances. Harvard has an nondiscrimination policy, which has existed since 1979. In this, is a stance against homophobic organizations recruiting via the Law School. It is not the military she dislikes, it is it's policies on gay and lesbian rights to openly join. Please, educate yourself before commenting in the future.

To state that top level Military commanders had NO voice in the policy is absurd to say the least.

By the by, she did not kick the ROTC off campus. They were more than welcome to recruit via the campus's Veteran Affairs group, which was a student run, on campus organization, with full rights to invite the recruiters as "guests" on campus, thus allowing them to do their jobs.
Perhaps, jeepndd, you ought to research the matter before blaming Kagan for this whole matter. Actually, Harvard has a pretty detailed account of everything involving these affairs...WELL before Kagan came to authority
