They never would have searched your vehicle if you rolled down your window and answered the simple question "Are you a U.S. citizen?". Actually, they can search the car without a warrant--there are certain exceptions to the warrant requirement and the car falls under the readily mobile conveyance exception.

In the event that a dog comes out and alerts to the car, the agents would be justified in forcefully extracting you in order to conduct their search. Whether or not you get prosecuted is another story, but if you have any contraband, your car can be seized. It's just not a smart move
What would be an even less smart move would be for Border Patrol agents to falsify a dog alert in order to compel someone out of their vehicle in order to search without a warrant MrGarky. Something a different set of Border Patrol agents did to the individual in this video.
Not to mention the fact that more & more evidence is showing dog alerts aren't all they're really cracked up to be. That dogs are actually very susceptible to overt or subtle signals from their handlers.
@CheckpointUSA I heard of the incident that you're talking about, but I don't ever recall seeing any kind of proof that the alert was falsified. Only that Anderson had no contraband in his vehicle.
I won't argue that dog alerts are sometimes unreliable. But their sense of smell is such that they will pick up odors of contraband from several days prior if there is still residue in the vehicle, in the seats, on clothes, in the ash tray etc. Was this the case? I don't know. Only Anderson knows.
No it wasn't the case MrGarky. I've read the agent incident reports & several of the legal filings. There were (2) K9 handlers there that night. The agent handling the dog wrote in his report the dog alerted as the vehicle drove by while entering the checkpoint while the 2nd, more experienced K9 handler, wrote the dog merely 'drafted' in the direction of the vehicle.
The agents didn't like the fact the driver was videotaping so the handler told the agents at primary to direct to secondary...
...on the basis the dog alerted. The driver challenged the alleged alert but the handler refused to bring the dog over to demonstrate the dog alerting again. Indeed, the handler refused to bring the dog over at the specific request of the AZ DPS agents as well. Why do you suppose the handler would refuse if the initial alert wasn't fabricated & the dog was accurate?
Anyway, after convincing the AZ DPS to assist with the physical assault & removal of the driver, the vehicle was driven over...
...to secondary where the dog was led around the vehicle - this time while stopped & with no other traffic distractions - and guess what? The dog didn't alert the 2nd time when there were more eyes watching what the handler was doing. Further, a thorough search of the driver's vehicle found, you guessed it, nothing. No dog alert, no illegal contraband.
At trial, it's my understanding either the 2nd handler or a different agent/officer testified that the dog never alerted despite the...

Does it matter what the dog handler tried to claim after the fact yoyo762? The agents/officers illegally extended the detention, physically assaulted the driver, falsely arrested the driver, illegally searched his vehicle and maliciously prosecuted him on the basis that they had probable cause from a dog alert. A dog alert that never actually took place.
When push came to shove in a court of law, the dog handler saved his own reputation and integrity ( sort of ) by admitting that he did not quite have a dog alert. In that way, he threw the other agents under the bus by not sacrificing himself and his credibility to help his fellow agents legality claim. What he did was hang his law brothers out to dry. He basically said they did not have a dog alert and what actions they took were illegal.
I think I see the confusion yoyo762. There were two dog handlers and only one dog. The dog handler who was actually handling the dog was the one who claimed throughout that the dog alerted. It was the second dog handler who was present but not handling the dog who wrote in his initial report and maintained throughout that the dog never alerted. The second handler is to be commended for reporting what actually happened while the first handler should be sitting in a jail cell right now.
Actually, according to the Bureau of Labor Statistics, law enforcement jobs aren't even in the top 10 most dangerous jobs in America jd3938. That honor goes to those who put their life on the line to fish, roof, ranch, drive, etc for a living. You really should learn to put things in perspective & stop trying to make it seem like it's perfectly respectable for gov't agents to trample on the rights of those you claim they're trying to protect.

Yes his speech is douchey, but that speech is protected by the 1st Amendment. He's fighting the laws that are on a slippery slope. Where does it end? First it's 75 miles from the border. Next year it's 200 miles. Then 200 miles from ANY port of entry in the U.S., including harbors and International Airports. So before you know it, we have Federal Border checkpoints in every state. Then reasonable suspicion is that you are driving a car. Everybody is then guilty until proven innocent.

People who defend these border patrol guys are just uninformed. Certainly, the border patrol agents have been brainwashed to violate our rights, and they're just doing their jobs. But the tendency to get on a power trip also factors in. The driver asked again and again what it was that caused them suspicion, and they had no reasonable answer. The fourth amendment says that you need probable cause for a specific item to be searched for, not just annoyance at an "uncooperative" person. Wake up!

So it's quite provable at this point that the dog never alerted MrGarky. You see a judge, jury & a court of law made that decision. That's why the trumped up charges against the driver were dismissed not once, but twice.
I wont even get into the growing body of scientific literature showing dogs are very susceptible to alerting based upon the desires of their handlers, be those desires consciously conveyed through physical signalling of some type or otherwise.

Actually, they can search the car without a warrant--there are certain exceptions to the warrant requirement and the car falls under the readily mobile conveyance exception.
They need probable cause, but no warrant.

In the event that a dog comes out and alerts to the car, the agents would be justified in forcefully extracting you in order to conduct their search. Whether or not you get prosecuted is another story, but if you have any contraband, your car can be seized. It's just not a smart move

What would be an even less smart move would be for Border Patrol agents to falsify a dog alert in order to compel someone out of their vehicle in order to search without a warrant MrGarky. Something a different set of Border Patrol agents did to the individual in this video.
Not to mention the fact that more & more evidence is showing dog alerts aren't all they're really cracked up to be. That dogs are actually very susceptible to overt or subtle signals from their handlers.

@CheckpointUSA I heard of the incident that you're talking about, but I don't ever recall seeing any kind of proof that the alert was falsified. Only that Anderson had no contraband in his vehicle.
I won't argue that dog alerts are sometimes unreliable. But their sense of smell is such that they will pick up odors of contraband from several days prior if there is still residue in the vehicle, in the seats, on clothes, in the ash tray etc. Was this the case? I don't know. Only Anderson knows.

No it wasn't the case MrGarky. I've read the agent incident reports & several of the legal filings. There were (2) K9 handlers there that night. The agent handling the dog wrote in his report the dog alerted as the vehicle drove by while entering the checkpoint while the 2nd, more experienced K9 handler, wrote the dog merely 'drafted' in the direction of the vehicle.
The agents didn't like the fact the driver was videotaping so the handler told the agents at primary to direct to secondary...

...on the basis the dog alerted. The driver challenged the alleged alert but the handler refused to bring the dog over to demonstrate the dog alerting again. Indeed, the handler refused to bring the dog over at the specific request of the AZ DPS agents as well. Why do you suppose the handler would refuse if the initial alert wasn't fabricated & the dog was accurate?
Anyway, after convincing the AZ DPS to assist with the physical assault & removal of the driver, the vehicle was driven over...

When push came to shove in a court of law, the dog handler saved his own reputation and integrity ( sort of ) by admitting that he did not quite have a dog alert. In that way, he threw the other agents under the bus by not sacrificing himself and his credibility to help his fellow agents legality claim. What he did was hang his law brothers out to dry. He basically said they did not have a dog alert and what actions they took were illegal.

I think I see the confusion yoyo762. There were two dog handlers and only one dog. The dog handler who was actually handling the dog was the one who claimed throughout that the dog alerted. It was the second dog handler who was present but not handling the dog who wrote in his initial report and maintained throughout that the dog never alerted. The second handler is to be commended for reporting what actually happened while the first handler should be sitting in a jail cell right now.
