  • Oh, just to let people know. Nexhit is no longer and they shut down literally within weeks after I sent them a cease and desist request....

    I guess these download sites are going to either eventually learn, make amends with those people who's rights they violated, or they might just simply go out of business.

    People have to be legitimate in order to restore faith in the system.

  • CD Baby is a rip off. They are selling a CD that has my performance on it, but I have NOT signed any Performande Release forms to allow the label and CD Baby to sell. I have had some of CD Baby's network to pull the content without too much hassle, but CD Baby won't pull it because they are a bunch of assholes. Derek should be thrown in Jail and CD Baby should go out of business. Artists and their labels need to get signed Release forms by each musician before they sell the content.

  • One has to have contracts in order to sell it and CD Baby doesn't ask for copies of the Release Forms, which means they aren't doing their job to make sure they work with legitimate record labels, plus i won't release a recording unless I like the content. That's why people do demo work and only sign contracts if they want to release it.

  • Plus, there is NO law that specifies that a musician has to sign contracts if they don't like their content or before they enter the studio. Performance Rights are a form of copyright and the only way someone can legally sell and distribute is to have a Performance Release form signed. I have had my content removed from many of their affiliates with little or no hassle, but some won't remove it, including CD Baby and they know that the label doesn't have Release Forms signed.

  • What's more sickening is that I have an email from one of their employees stating that they get a lot of complaints a day and they won't pull anything unless you hire an attorney to sue them. How many local musicians have enough money to hire an expensive Entertainment Attorney to get a court order in another State? No many.

  • You know what is really funny? If you go to Wikipedia and look up CD Baby, it states the Derek didn't want to compete in the MP3 download market. Well, I guess he changed his mind, didn't he?

  • You are a f'n dunce and a half! It's not CD Baby or any distributor's business to worry about whether the musicians on the CD's they sell have signed a performance release agreement. Hash it out with the band/artist that employed your services. DUH! CD Baby rules - we have cleared 6 grand in 6 months thru them on one title alone. They are THE best thing to happen to indie/DYI artists probably EVER!

  • Yes it is. They have to make sure that each record label submits product that has all of the legal rights to distribute, if they don't, then they are held liable. How come other companies that get the product FROM CD Baby remove the content? When you don't check to validate that contracts are signed with the musicians then you are held liable for selling illegal content. All they have to do is work only with legitimate record labels that can submit copies of signed release forms. PERIOD.

If you're a musician-for-hire (as opposed to a full band member) on a record you sign off on your performance for a one-time fee and sign over your rights. That's it. Done. Anything else is blatant amateur hour.

  • How else is someone going to make certain that the Release forms have been signed? Well, that's why this artist is is Amateur Hour. That's why the musicians on the guy's first project don't deal with him. We don't know until AFTER the session.

  • I was told that the guy in the early 90's tried to get a distrubution deal with a reputable distribution company, but they only want to talk to legal representation, not the artist directly. Why? For legal reasons.... This "demo" was done in the early nineties before the internet was born, so there was no way for anyone to know about the internet laws with copyrights.

  • Many musicians don't sign Release forms until AFTER the recording is made so they can decide if the tracks in question are worth selling or not. It isn't law to sign before the tracks are laid down, but it is law that they be signed prior to selling and the release forms have to be specific in verbiage. Why do you think some bands don't release their content as downloads when everyone else is?

  • It is also my understanding that if an attorney is doing ANYTHING with regards to Entertainment law that they MUST be a practicing Entertainment Lawyer, otherwise they might be subject to being disbarred. I told the artist prior to doing the session to get an attorney, but he didn't for whatever reason. Either way, what he is doing is illegal and since CD Baby is continuing selling it with full knowledge that proper release forms aren't signed.

  • Personally, I really don't understand why bands go after these download sites? I can see a big name artist using a record company to do the distribution, but local bands just need to post their own content on their own site, get an Entertainment lawyer to make sure contracts are signed and reap all of the money. It's stupid easy to sell content without paying CD Baby or other download sites money unless you have an established name and don't want to be bothered with the distribution end.

  • Indie artists use CD Baby because you get far wider distro, both for physical product and downloads, than you ever could on your own. So you lose 9% of your revenue - that is an acceptable price to pay (compared to the pittance labels pay you in royalties). You want your music where most people go to buy it - and that's iTunes, Amazon, Rhapsody, CD Baby, not your website that gets 27 hits a day.

  • Most local artists sell to those that hear them at bars and local concerts. If the band starts playing regionally or nationally, then they get a wider appeal. Not many bands will sell that much content outside of the areas for which they play. If one can go to CD Baby, one can easily set up a MySpace site or something similar. I've looked at CD Baby content and still have yet to find something worth buying. Most CD projects lose money.

  • Selling $6,000 worth of content is chump change. That's about 600 units. $10 a unit. Right?

    Any local band that's any good can EASILY sell that many CD's locally if they are decent. It's all about how much the band/artist promotes themselves.

    Most people I know don't go phishing for content that they have never of. They usually go for stuff they seen live or heard from another source or read a review.

    Either way, legit bands do things by the book and that's how it's supposed to be done.

  • Here's what kinda funny is that Mr. Reborn had another Christian CD that he did with other Christians and it was a Christian only site and it just got pulled recently. I don't know what happened, but he can't even sell his Christian music on a Christian only site........ hahaha.

  • Well, not everyone that submits content through CD Baby is legal to sell and they should remove illegal content immediately. If they don't, then they are held liable for their end of it. They know the content that I was on is illegal to sell and other companies that were obtaining this content removed it. Actually, all of the big publically traded companies have removed the content. Why not CD Baby? BECAUSE THEY ARE GREEDY ASSHOLES VIOLATING FEDERAL LAWS.

  • 'Illegal content' my ass! You need to take care of business/paper work upfront, not when the artist you were in a band with or hired you to play on his CD ships off 10 CD's to sell via CD Baby. Did you also go into any local record store that might have stocked the 'offending' CD on consignment and started to scream at the manager, "YOU ARE SELLING ILLEGAL CONTENT! REMOVE IT AT ONCE!!!" This is pathetic and ridiculous.

  • The guy made 10,000 CDs AFTER the demo was made and he did it without asking anyone. SubuPtolemy, why would I sign a Performance Release form prior to recording? What if I don't like my own performances?

    Did you read any of my cease and desist letters or emails? Or are you just recanting what some idiot told you? One of the companies I sent a cease and desist email pulled the guys account altogether, but I don't think they got the content from CD Baby.

    How come other companies like iTunes, Napster, Amazon, Tradebit, BitMunk, Audio Lunchbox, and a bunch of others that got the content from CD Baby have removed the content with a simple Cease and Desist letter or email? Because they know the law and have a fiduciary responsibility to remove illegal content that doesn't have signed Release Forms. I have already set precedence. DUH..

  • iTunes, Amazon, et al are big corporate entities that have better things to do than bother getting into legal arguments with hysterical weekend musicians like you. They'll gladly live w/o the $33.57.- they'd have made off your music over the next 10 years. It has nothing to do with 'the law'. Frankly, I don't know why CD Baby would want to deal with your kind but then again - they're a grassroots company and they do know the law. And it's on their side, amigo.

  • You obviously don't understand Entertainment law. I've been on other similar demo projects whereby I didn't sign release forms either because they didn't offer it to me, or i refused because the overall recording wasn't to my satisfaction. I've been on jingles that I did sign contracts. Do you have an Entertainment lawyer ensuring your content is legal?

    The artist is running a record label out of his house without an Entertainment lawyer and is a self-righteous Christian that is pathological liar as far as I am concerned, but that's another story...

    Actually, I think what CD Baby is doing everyone a dis-service. If they only sold content whereby all of the labels have legally signed contracts, then they are doing their job. The problem is that not all indie labels have entertainment lawyers to ensure legal contracts are signed.

  • Dude, if you are so horrified at how the artist is conducting business and working out of his home instead of a fancy office building - then why did you get involved with him in the first place? And why would you want to hold CD Baby accountable for that? Again, it's not CD Baby's duty to make sure your i's are dotted and your t's are crossed. That's YOUR job! Make sure your ass is covered beforehand, not after the fact! It's really not that complicated with a little common sense.

  • Because he told everyone that it was going to be a DEMO to see if he could get a recording contract, but he turned around 16 years later and starting selling it on-line. He wasn't a self-righteous Christian at the time, he got "reborn" a while after. I haven't dealt with the guy in over 4 years because of his drinking problem. He wasn't selling until 2 years after I stopped dealing with him. Yes it is CD Baby's responsibility to ensure they are selling legal content.

  • Who cares whether it was a demo or meant for an album all along? If you want to make sure your 'demo' performance isn't released as product down the line - why did you not insist on getting things in writing right there and then?! Seriously, Mr.Reborn Xian might not have gone by the book but you were stupid for letting things happen. To then go harass CD Baby 16 years later instead of sorting it out with Mr.Reborn is absurd. Sue his ass for a one-time fee or a cut of the profits if you have to!

  • I had to listen to the final tracks and I didn't think they were good enough to sell. Cd Baby just started selling them a couple of years ago when Mr. Reborn did the deal with them.

    If i had the money to hire an attorney, I would have sued them a LONG time ago. What do you mean "Letting" things happen. I kicked Mr. Reborn out of my house for drinking and hadn't talked to him and then 2 years after I kicked him out of my house he starts posting the crap on CD Baby, etc.

I can't believe these guys that promote themselves in these comments....it's almost as bad as me saying "check out my 'AFRICAN RAIN" album at cdbaby!!

    I have also gotten some cool releases from other artists like Stephane Wrembel that I could not have obtained in any other way. Three cheers for Derek and the whole CD Baby crew.
