The show featured footage of 5 or so police officers physically forcing a drunk bloke into having his photo taken/fingerprints etc. Ok the guy was pissed but the level of force used against him was fairly shocking. Am I right in thinking this was common law assault on the part of the police?

If you are detained, make it clear in the station you did not consent to the arrest and will not consent to the search, if put in a cell if you want a solicitor, speak to him/her about the case. You feel the police have broke the code of practise, you have been unfairly targeted and discriminated against. It would be a huge slam dunk if you recorded the event.

I think that just refusing to talk isn't enough to protect our rights anymore...Most people have facebooks/online profiles. If detained or threatened with detainment, police officers don't even need to have you talk if you are in possession of an online "social networking" profile that gives your personal details. So, although these are good tips, they don't completely protect someone from having their rights infringed upon.
@manmythlegend12 how will they know who you are on various social networks if you are not obliged to provide your name. they do not have any right to know anything about you, when you leave their cell after a few hours, you will be an anonymous to them as someone living in nepal who theyve never met - make sure you dont say a word and keep a password on your phone in case they forcefully take it as 'evidence'.

Taking away weapons and constantly searching slaves and their property is how slave owners kept control, is it not? If you have the right questions to hand, I always advocate asking them. They usually begin with "Am I obliged to..?" or "What law obliges me to..? Asking questions prevents any claims of dishonour but most people don't know their rights and do not care enough about them to arm themselves with the right questions. Once your rights have been reserved, tacit acceptance cannot be assumed or presumed. Otherwise, silence, after reserving your rights, is your best weapon.

I think when they "You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to be speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense." and then say "Do you understand" you should say no and then you have the right to remain silent.
I am not a cop but I am pro-police, especially UK police, as anyone who's read my posts knows. Complain and protest EVERY time you have been arrested illegally. See a lawyer ASAP. And campaign hard for an independent complaints commission. The police have nothing to fear as long as it's fair and transparent and observes the rule of law. Most cops I know want that themselves.
Thanks for the information, Anti-T. A policeman entered my girlfriend's house while I was there. I answered his questions only because I thought something had happened to my girlfriend's daughter. It's not happened since, but if it does I'll remember what you said. We just have to learn to see through the intimidating facade of the police uniform and manner.
Fitting the description may be enough to warrant a detention but certainly not for an arrest. I would be helpful enough to stand still long enough for him to get a good look at me but if he cannot ascertain probable cause for an arrest within 5 mins i would be looking to leave. If someone has been told i look like someone he is looking for, does that oblige me to answer his questions?
Doesn't the terrorist act in britain allow the police to detain someone who they think are suspicious for 48 days and the act itself does not make it clear whether or not you have the right to refuse to give a police officer something personal.

I live in a small town, and a lot of the sheriffs around here ARE good people, but there are those who want to arrest you or just badger you over nothing. I know my rights, and I ask them the questions if I get pulled over. And it bothers them, it bothers them that I ASK the questions. "Why did you pull me over Officer?", that question immediately requires and answer, such as "Uh, you're tail light is out.", and then you ask what Anti said "Am I free to go?" That's really it.

Not so long ago I made a complaint against a police officer and as a result of this I received a visit from another officer who said "You have made complaints against police in the past have'nt you? Right, you're on the list". When asked to explain what exactly this list was the officer denied having made this statement. Also I was served wih a harrassment warning on paper which bore no date, did not give my name nor that of the issuing officer. When I complained about this....

I had an exchange with an enforcement officer on Independence Day. At the Santa Monica Pier after the Tea Party protest a friend waited at the curb with my bbq and ice chest while I fetched my truck. I waited for two buses to clear the bus zone & pulled over. A power driven officer frantic with the thousands of people told me to leave or I'd be ticketed. Long story short. I proceeded to load up & he gave me a $300 citation. I will fight it and win. He had no idea about anything I explained.

A few days ago we where standing for a longer period in a group of 8 persons on a public sidewalk just talking to each other. A police squad surrounded us with multiple cars and took everybody's ID and warned us to go home within 5 min. They said it's forbidden to stand there and If we wouldn't go away we would get a fine. Abuse of search laws is dead-on accurate. There's video & audio evidence of Police illegally searching a home that was and is equipped with multiple mini surveillance cameras and microphones throughout. With exterior posted signs indicating as such. The Police denied the search occurred. The Police were shown their illegal conduct directly by the homeowner. The police requested copies of the evidence. All Police requests have been denied. The homeowner has been placed under heavy surveillance.
It has never been illegal to voice record an officer when encountered. I believe that legislation has now been passed that makes the police force part of the armed services making it illegal to video them. I would simply inform the officer you are recording the conversation for your records. If he tells you you can't, ask him for the law that prevents you from doing so. When he cites a statute, ask him if statutes enjoy the force of law without your consent. Wash, rinse, repeat as necessary.
I was arrested for something I wasn't involved in. When I was taken to the station... I refused to give DNA, finger prints and photograpghs... and an officer said, "We now have several methods of force to get those from you, and it can get unpleasant".... after being in a cell for 6 hours... I'd had enough... and I assumed that he was being serious and would make my unjust experience even worse... so I agreed to give my DNA, fingerprints and picutures..... Was that officer talking crap?

its damn hard not to be coerced into a contract. they will unlawfully arrest you and charge you. you wont get bail because you are not confirming your identity with them and so the next day youll be in court. i would only recommend this if you know how to assert your self in court thoroughly. if you slip up in court youve had it, and the judge will be harsh with you for making him angry.

If you have the right questions to hand, I always advocate asking them. They usually begin with "Am I obliged to..?" or "What law obliges me to..? Asking questions prevents any claims of dishonour but most people don't know their rights and do not care enough about them to arm themselves with the right questions. Once your rights have been reserved, tacit acceptance cannot be assumed or presumed. Otherwise, silence, after reserving your rights, is your best weapon.

I think when they "You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to be speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense." and then say "Do you understand" you should say no and then you have the right to remain silent.

I am not a cop but I am pro-police, especially UK police, as anyone who's read my posts knows. Complain and protest EVERY time you have been arrested illegally. See a lawyer ASAP. And campaign hard for an independent complaints commission. The police have nothing to fear as long as it's fair and transparent and observes the rule of law. Most cops I know want that themselves.

Thanks for the information, Anti-T. A policeman entered my girlfriend's house while I was there. I answered his questions only because I thought something had happened to my girlfriend's daughter. It's not happened since, but if it does I'll remember what you said. We just have to learn to see through the intimidating facade of the police uniform and manner.

Fitting the description may be enough to warrant a detention but certainly not for an arrest. I would be helpful enough to stand still long enough for him to get a good look at me but if he cannot ascertain probable cause for an arrest within 5 mins i would be looking to leave. If someone has been told i look like someone he is looking for, does that oblige me to answer his questions?

Doesn't the terrorist act in britain allow the police to detain someone who they think are suspicious for 48 days and the act itself does not make it clear whether or not you have the right to refuse to give a police officer something personal.
If anyone could reply it would be helpful as I know this act was updated only a few months ago.

i started filmin the police arresting someone on a highstreet and they heard me say how police officers does it take to arrest one person and the cop got really agressive with his nature and was telling me to turn off the phone or he was gonna sease it i didnt really know my rights so i stopped eafter he got closer and closer ive refused the police in my house once and looked really suprised

I live in a small town, and a lot of the sheriffs around here ARE good people, but there are those who want to arrest you or just badger you over nothing. I know my rights, and I ask them the questions if I get pulled over. And it bothers them, it bothers them that I ASK the questions. "Why did you pull me over Officer?", that question immediately requires and answer, such as "Uh, you're tail light is out.", and then you ask what Anti said "Am I free to go?" That's really it.

I was stopped to the tune of "whats your fucking name"shouted at me several times by a member of lancs police.
When i asked why i was stopped he shouted it again.
I then replied im not giving it you untill you tell me why you have stopped me,he then said he was taking me to the station.

Superb vid man. Not so long ago I made a complaint against a police officer and as a result of this I received a visit from another officer who said "You have made complaints against police in the past have'nt you? Right, you're on the list". When asked to explain what exactly this list was the officer denied having made this statement. Also I was served wih a harrassment warning on paper which bore no date, did not give my name nor that of the issuing officer. When I complained about this....

2. an ammended though unsatisfactory version was issued to which I responded, "If the first version was inadequate as a harrassment warning then I do not consider myself to have received a harrassment warning at all." I have asked for clarification of this matter from Police HQ. They have written back simply refusing to answer my questions.
They seem to think that might is right.

I had an exchange with an enforcement officer on Independence Day. At the Santa Monica Pier after the Tea Party protest a friend waited at the curb with my bbq and ice chest while I fetched my truck. I waited for two buses to clear the bus zone & pulled over. A power driven officer frantic with the thousands of people told me to leave or I'd be ticketed. Long story short. I proceeded to load up & he gave me a $300 citation. I will fight it and win. He had no idea about anything I explained.

In the USA officers always ask for me to remove my hands from my pockets (it is a habit) This has happened when I was witness to an accident and witness to a crime. I was a bit taken aback because I was only a witness and not even suspect. They were very firm and I hate to admit that I did it. My question is.. in the USA am I obliged to remove my hands from my pockets?

HELP! i got caught speeding by the police , they were using a hand held gun device, i saw no warning signs. got pulled over and gave name and address, they said because i was caught doing 60 in a 30 zone, that its likley i will go to court for dangerouse driving rather than just 3 points. they said i would get a letter in 2 - 3 months. problem is i have only had my licence less than a year so 6 points would mean a full re-sit. what should i do if i am summoned, should i go and represent?

AntiTerrorist, I want to ask you a question about the police in The Netherlands. A few days ago we where standing for a longer period in a group of 8 persons on a public sidewalk just talking to each other. A police squad surrounded us with multiple cars and took everybody's ID and warned us to go home within 5 min. They said it's forbidden to stand there and If we wouldn't go away we would get a fine. I don't understand that is forbidden for us to meat friends in our living area and stand on the streets spending time with each other. It happened many times to us and manny other people in our district. Much of us in the past even got arrested for it. Is this practice legal and lawful in a so called FREE SOCIETY? How can we act as a group of young people against the police when this occurs again? (watch previous comment before reading this)

Abuse of search laws is dead-on accurate. There's video & audio evidence of Police illegally searching a home that was and is equipped with multiple mini surveillance cameras and microphones throughout. With exterior posted signs indicating as such. The Police denied the search occurred. The Police were shown their illegal conduct directly by the homeowner. The police requested copies of the evidence. All Police requests have been denied. The homeowner has been placed under heavy surveillance.

It has never been illegal to voice record an officer when encountered. I believe that legislation has now been passed that makes the police force part of the armed services making it illegal to video them. I would simply inform the officer you are recording the conversation for your records. If he tells you you can't, ask him for the law that prevents you from doing so. When he cites a statute, ask him if statutes enjoy the force of law without your consent. Wash, rinse, repeat as necessary.

I was arrested for something I wasn't involved in. When I was taken to the station... I refused to give DNA, finger prints and photograpghs... and an officer said, "We now have several methods of force to get those from you, and it can get unpleasant".... after being in a cell for 6 hours... I'd had enough... and I assumed that he was being serious and would make my unjust experience even worse... so I agreed to give my DNA, fingerprints and picutures..... Was that officer talking crap?

its damn hard not to be coerced into a contract. they will unlawfully arrest you and charge you. you wont get bail because you are not confirming your identity with them and so the next day youll be in court. i would only recommend this if you know how to assert your self in court thoroughly. if you slip up in court youve had it, and the judge will be harsh with you for making him angry.
please correct me if i am wrong - this is my understanding of it.
