This is why you should NEVER sign anything without reading it first. Yes, I mean the fine print. I have come across a number of petitions that contradicted what the signature-gatherers said about them, but I would never have known if I hadn't taken the time to read them. My policy is if I don't have time to read it, I don't have time to sign it.
Similar tactics were used in MA a few years back where collectors would show a petition for say, "Saving the local Humane Society." Meanwhile, the collector would turn the page half way up the clipboard and have the people quickly sign the anti-gay marriage amendment underneath before anyone knew what was happening. There was even a web page dedicated to those who believed they were duped. They could call a number to report the fraud. Can't win? CHEAT! Turn this in pronto, Watersrobmax!

I'm not a lawyer and I typically find such things exhausting now after all this time, but I do believe falsely representing a petition is illegal. Am i right or wrong? This doesn't seem legal to me. I would be upset to find that I had put my name on such a thing when i was told it was something else. I don't know why you are assuming that this signature gatherer is a Christian and if she is, please don't believe that she represents all or even most Christians.
I am a Christian, a public school teacher, mother, seminarian and lesbian who fully supports SB 48 and thanked God when it was passed.
It is the responsibility of all to educate those in our circle of influence with the truth.

Please report his as election fraud. Go to the CA Sec. of State website and then add /elections/fraud-complaints/ to the URL.
If anyone else witnesses something similar, please get the names of the people involved (petition circulators legally must identify themselves to you), the specific petition they're circulating, and gather as much documentary evidence as you can (like shooting a video). Then REPORT IT. That's the only way we can stop fraud like this.
To follow up that comment by @sillysot: When you make the report, reference sec 18600 of the CA elections code, which bars petition circulators from "intentionally misrepresenting the contents, purport or effect of that petition to a prospective signer."
@dysperdis, under 18601 of the CA elections code, "An arrest or conviction pursuant to this section shall not invalidate or otherwise affect the validity of any signature obtained by the person arrested or convicted." I wonder if this could be precedent toward Section 18600 as well, and those signatures could also still be valid.
I encountered the exact same type of lies being used to obtain signatures outside a supermarket in Fallbrook, CA (which isn't too far from Oceanside). Although they were not the same women pictured in your video, I was approached and asked to sign a petition to "help stop child molestation". I declined to stop as I was in a hurry but was shocked to discover after walking a few more yards another woman sitting at a card table with a prominent sign reading "Stop Sex Offenders - Stop SB 48"
In my local paper there was a letter to the editor complaining about how SB48 was "going to teach kindergarteners about same-sex marriage". Talk about missing the boat and rehashing the Prop 8 campaign.
This is fraud. Law enforcement should be able to arrest people on the spot for actions like this. Support what you want, but when attempting to collect signatures to gain a ballot measure, everything should have to be factual and correct -- otherwise the signatures gained should be invalidated. I hope this video can be used to quash their attempts to revoke the FAIR education act.
@airtexaco the law doesn't require schools to teach about gay sex. It merely requires school to teach about history of the movement like the protests of the Stonewall Inn, and people like Bayard Rustin who was one of Martin Luther King's most influential individuals and was key in the million man march on washington DC who was gay as well. Has nothing to do with sex.

@socalvet, it appears to be a misdemeanor offense. It doesn't look like the California Elections Code explicitly says that gathering signatures this way invalidates those signatures, but the Code does appear to say that this is criminal activity. I believe that we could risk barking up the wrong tree if we don't have a solid understanding of the laws surrounding the signature gathering process.
@SeanChapin1 I would think that the people who signed it could sue to have their signature removed if it was proven they tricked them into signing something else. I've always thought tricking someone into signing a legal document without a full understanding of what they were signing is fraud and criminal.
I recommend that you contact the local media (TV/print) via email and pass the video or this link to them. Also your State Senator (unless it is a Republican) or Sen. Mark Leno & Sen. Christine Kehoe both supportive of LGBT rights and pass the link to them too! These lies need to be addressed publicly!

I do NOT agree with the tactics they are using but I do not agree with teaching those items in schools. BUT, the great thing about States Rights is that if a state does bring in something I don't like I can always move. I would never try to be misleading-it is an awful way to make a point.

I just penned two articles about SB 48 in an effort to combat this type of deception. I was inspired to write these articles when a prominent African-American minister used his influence and pulpit to do much the same thing seen here in the video. I don't usually comment on videos, but the Chelsea he is referring to was my best friend who died due to the fault of our judicial system and sex offender monitoring. She accepted me as openly homosexual. I don't know how these people could even consider using her name and her story to be used in this context. I am so beyond pissed right now

Sweetheart, I'm guessing by the rest of your comment that you're a)straight and b)anti- homosexuality or non-traditional gender expression or both. So you don't really have any right to tell those people how they should represent themselves: if they want to put the lesbians first in their acronyms, what business is it of yours? And in any case, one is no more correct than the other: several major queer organizations use LGBT, and other use GBTL. Um. Fail. Epic fail all around.

That implies that you think there is an entire community of people (hundreds of thousands of people) who are seriously interested in, and are undertaking actions to harm and/or dismantle society. Please report his as election fraud. Go to the CA Sec. of State website and then add /elections/fraud-complaints/ to the URL.
If anyone else witnesses something similar, please get the names of the people involved (petition circulators legally must identify themselves to you), the specific petition they're circulating, and gather as much documentary evidence as you can (like shooting a video). Then REPORT IT. That's the only way we can stop fraud like this.

To follow up that comment by @sillysot: When you make the report, reference sec 18600 of the CA elections code, which bars petition circulators from "intentionally misrepresenting the contents, purport or effect of that petition to a prospective signer."

@dysperdis, under 18601 of the CA elections code, "An arrest or conviction pursuant to this section shall not invalidate or otherwise affect the validity of any signature obtained by the person arrested or convicted." I wonder if this could be precedent toward Section 18600 as well, and those signatures could also still be valid.

I encountered the exact same type of lies being used to obtain signatures outside a supermarket in Fallbrook, CA (which isn't too far from Oceanside). Although they were not the same women pictured in your video, I was approached and asked to sign a petition to "help stop child molestation". I declined to stop as I was in a hurry but was shocked to discover after walking a few more yards another woman sitting at a card table with a prominent sign reading "Stop Sex Offenders - Stop SB 48"

In my local paper there was a letter to the editor complaining about how SB48 was "going to teach kindergarteners about same-sex marriage". Talk about missing the boat and rehashing the Prop 8 campaign.

This is fraud. Law enforcement should be able to arrest people on the spot for actions like this. Support what you want, but when attempting to collect signatures to gain a ballot measure, everything should have to be factual and correct -- otherwise the signatures gained should be invalidated. I hope this video can be used to quash their attempts to revoke the FAIR education act.

It merely requires school to teach about history of the movement like the protests of the Stonewall Inn, and people like Bayard Rustin who was one of Martin Luther King's most influential individuals and was key in the million man march on washington DC who was gay as well. Has nothing to do with sex.

@socalvet, it appears to be a misdemeanor offense. It doesn't look like the California Elections Code explicitly says that gathering signatures this way invalidates those signatures, but the Code does appear to say that this is criminal activity. I believe that we could risk barking up the wrong tree if we don't have a solid understanding of the laws surrounding the signature gathering process.

I've always thought tricking someone into signing a legal document without a full understanding of what they were signing is fraud and criminal.

I recommend that you contact the local media (TV/print) via email and pass the video or this link to them. Also your State Senator (unless it is a Republican) or Sen. Mark Leno & Sen. Christine Kehoe both supportive of LGBT rights and pass the link to them too! These lies need to be addressed publicly!

I do NOT agree with the tactics they are using but I do not agree with teaching those items in schools. BUT, the great thing about States Rights is that if a state does bring in something I don't like I can always move. I would never try to be misleading-it is an awful way to make a point.
