The cops in the UK use traffic offences as a revenue stream. They target motorists just to get money out of them in fines and financial penatlies. The local government does it with parking violations. It's a way of getting money.
We also have cameras everywhere. You can't walk through London without being filmed. They can track a vehicle from one end of the country to the other just with cameras. They're on all major trafic routes....and some minor ones too. Big brother is truly watching us.

If you are driving without a licence or without registration, bald tyres etc of course there should be random stops to ensure compliance. If a driver is drunk this is the only effective way to stop them. Over use of this system is a problem but public safety comes first.

Although driving is a privilege and drivers generally agree to show their driver's license on demand to police officers, it is nevertheless unconstitutional for police officers to stop vehicles at a checkpoint unless the either have a reasonable and articulable suspicion of criminal activity or the stop is completely without discretion.

Without reasonable suspicion or a DUI checkpoint, stops like this are illegal. You cannot be stopped for no reason whatsoever, with the exception of a DUI check.
Even the states that have a stop and ID law, they can't just stop for no reason -- there have to be articulate facts supporting the stop.

There are some states such as Washington and Alaska that have made it illegal to produce these checkpoints. I am very concerned about the fact that the number of checkpoints in the US have been steadily increasing, restricting the freedom to travel freely within the US.
Seems that if the stop is a regulatory stop, it passes as legal according to the Supreme Court. Somehow, our 4th amendment rights can be trampled if the state deems it necessary. I wasn't aware of any exceptions for such things in the US Constitution.
Either way, when stopped at any checkpoint, provide what is minimally required at the time (license, insurance, registration), and say nothing. Answer nothing. And don't do any field tests (walk the line, etc.).

However, the police have no reason to think you don't have a license, so they can't demand you present it; they can ask you do, but they can't demand it. A traffic stop is different. If they observed you commiting a traffic violation, i.e. speeding then you must present ID, registration, and insurance. But yo don't have to for a random checkpoint stop.
You need to check with the DMV and they will be happy to explain the law to you. When you operate a motor vehicle you are required to carry license registration proof of insurance AND show it when asked by a police officer. Period.

The Supreme Court, in 542 U.S. 177 (2004), decided that identification need only be present during "police investigations", not 'on demand' as you put it. They also decided that there is no requirement to present a physical form of identification. This ruling trumped any state laws that required more than this.
There's adifference between stop and identify laws and traffic stops. Most states make you sign a document when you get your license agreeing to hand it over on demand. The rationale being that it's not used for "ID" but merely to verify that you are, in fact, a legal driver. If you are on foot or you are the passenger you are not required to produce your license, unless your state has a stop and identify law. At about 2:12, the videographer said the police said they were doing every 5th vehicle. But the lady said they stopped the vehicle in front of her, as well as hers. That makes this an unconstitutional stop.

I would just add to your list of steps to take: get and use a video camera to record every encounter you have with the police. If you just document on paper then it becomes a battle of documents...your notes vs. the cop's notes. With the video, there is no doubt what happened---which is why cops hate you video recording them.

I was implying that they should have these requirements for becoming a police officer. Because the job is so mentally demanding, I would like to see the highly educated people doing this job and not people with a H.S. degree. Second, the lady was stopped immediately after the car in front of her, and was not stopped for a violation, so they were NOT stopping every fifth car. That, too, is unconstitutional, per Delaware v. Prouse.
Actually, ancient China had a police force. Athens in 300 BC kept Scythian slaves to act as a police force. Police were not invented in the United States or to exclusively catch slaves (although they may have been used for that purpose just as Africans organized themselves to capture other Africans as slaves so they could sell rival tribes to the Europeans).

The cops in the UK use traffic offences as a revenue stream. They target motorists just to get money out of them in fines and financial penatlies. The local government does it with parking violations. It's a way of getting money.
We also have cameras everywhere. You can't walk through London without being filmed. They can track a vehicle from one end of the country to the other just with cameras. They're on all major trafic routes....and some minor ones too. Big brother is truly watching us.

They MUST have probable cause.
When an officer detains you, ASK THEM why you're being detained or even IF you are. "officer am I being detained?". What is the purpose of detainment?
Be pro-active. Don't let them ask the questions and don't give them any more answers than Name and ID.
DO NOT consent to any searches without probable cause.
EVEN if they pull the old "drug dog alerted" trick.

Although driving is a privilege and drivers generally agree to show their driver's license on demand to police officers, it is nevertheless unconstitutional for police officers to stop vehicles at a checkpoint unless the either have a reasonable and articulable suspicion of criminal activity or the stop is completely without discretion.
Here, officers decided on the spot which vehicles to pull over.
This was an unconstitutional checkpoint.

Without reasonable suspicion or a DUI checkpoint, stops like this are illegal. You cannot be stopped for no reason whatsoever, with the exception of a DUI check.
Even the states that have a stop and ID law, they can't just stop for no reason -- there have to be articulate facts supporting the stop.

There are some states such as Washington and Alaska that have made it illegal to produce these checkpoints. I am very concerned about the fact that the number of checkpoints in the US have been steadily increasing, restricting the freedom to travel freely within the US.

Seems that if the stop is a regulatory stop, it passes as legal according to the Supreme Court. Somehow, our 4th amendment rights can be trampled if the state deems it necessary. I wasn't aware of any exceptions for such things in the US Constitution.
Either way, when stopped at any checkpoint, provide what is minimally required at the time (license, insurance, registration), and say nothing. Answer nothing. And don't do any field tests (walk the line, etc.).

However, the police have no reason to think you don't have a license, so they can't demand you present it; they can ask you do, but they can't demand it. A traffic stop is different. If they observed you commiting a traffic violation, i.e. speeding then you must present ID, registration, and insurance. But yo don't have to for a random checkpoint stop.

You need to check with the DMV and they will be happy to explain the law to you. When you operate a motor vehicle you are required to carry license registration proof of insurance AND show it when asked by a police officer. Period.

TheJomogogo: Although many states require drivers to show their license, etc., when asked by a police officer, the U.S. Supreme Court has held that it is unconstitutional for officers to stop drivers except in certain cases.
One case is where they have a reasonable and articulable suspicion that the driver is involved in criminal activity. Hiibel v. Nevada
The other is at a constitutional checkpoint. Since officers were stopping people here at their discretion, this was not constitutional.

Presenting your license on demand is usually a condition of receiving the license. So, on that point youre wrong. The best thing to do at a checkpoint is present the license, Tell the cop that you do not consent to a search and ask if you are free to leave. If they say yes do so immediately if they say no ask for a lawyer and shut up

Nothing on my Texas DL there about showing it on demand.
The Supreme Court, in 542 U.S. 177 (2004), decided that identification need only be present during "police investigations", not 'on demand' as you put it. They also decided that there is no requirement to present a physical form of identification. This ruling trumped any state laws that required more than this.

There's adifference between stop and identify laws and traffic stops. Most states make you sign a document when you get your license agreeing to hand it over on demand. The rationale being that it's not used for "ID" but merely to verify that you are, in fact, a legal driver. If you are on foot or you are the passenger you are not required to produce your license, unless your state has a stop and identify law. Look, I agree that this is bull shit but they're W/in the law to ask for DL

You are correct now that you added that it pertains to someone driving something that requires a license.
However, you earlier said that I have to produce my license on demand, which is quite false.
I am trying to make people aware that no one is required to produce any physical form of identification just because someone asks for it.
And yes, they are within the law to ask, just as I am within to law to decline at times.

Although some states such as California have laws saying drivers must show their license and registration to police on demand, the police nevertheless are not allowed to stop drivers at random or a hunch. Doing so constitutes an unreasonable "seizure". Police must either stop you at a constitutional checkpoint (where police do not use discretion in deciding whom to stop) or have a reasonable and articulable suspicion of criminal activity.
Here, they sometimes had neither.

Actually the "Terry Stop" language is "reasonable suspicion based on clearly articuable facts" And the police stated that they were stopping every X vehicle which fits your constitutionality mandate. None of this changes the fact that the side of the road is not the place to argue the point. Officer, I do not consent to any searches. Officer I do not wish to answer any questions W/out consulting an attorney. Officer, am I free to leave? If he says yes do so. If not see response "B"

It does not matter what the police STATE they are doing. It matters what they ARE doing.
At about 2:12, the videographer said the police said they were doing every 5th vehicle. But the lady said they stopped the vehicle in front of her, as well as hers. That makes this an unconstitutional stop.

I would just add to your list of steps to take: get and use a video camera to record every encounter you have with the police. If you just document on paper then it becomes a battle of documents...your notes vs. the cop's notes. With the video, there is no doubt what happened---which is why cops hate you video recording them.

I was doing my job? Thats a big problem with police, it's illegal for them not to follow orders. If they don't turn you in, they lose their job. This is how I see it:
Undergraduate degree in Psychology required for any patrol officer AND Masters and Doctorates for higher ranking officers.
Also with the higher education we could pay them better and maybe they would help make a more significant and positive influence on a community.

Patrol officers are governed by STATES. Different states have different requirements. For sure, California does not have that requirement.

I was implying that they should have these requirements for becoming a police officer. Because the job is so mentally demanding, I would like to see the highly educated people doing this job and not people with a H.S. degree. A police officer should be one of the hardest job's to get in America, not something you fall back on or because it was easy to get. I just want to raise the standards.

See I heard it differant.. The first Police were started in New York to protect the wealthy neighborhoods from Irish Immigrants, and newly freed Slaves from the south.. The first "official" police department was ran by an Irishman, and he recruited from the Irish Immigrant population, the first badges were made out of copper. Hence the term "cop" or.. "copper".... South may have been differant but, to protect the wealthy seems to be the theme on it all.... Peace.

Any checkpoint for the purpose of checking drivers license, registration, and insurance must be completely discretionless, such as stopping every fifth vehicle.
In this case, vehicles were stopped according the the officer's whim. That is a violation of the 4th Amendment. See Delaware v. Prouse.

First, I know that general crime-fighting checkpoints, even if only for "safety compliance", are unconstitutional. Indianapolice v. Edwards.
Second, the lady was stopped immediately after the car in front of her, and was not stopped for a violation, so they were NOT stopping every fifth car. That, too, is unconstitutional, per Delaware v. Prouse.
The checkpoints were illegal.

Actually, ancient China had a police force. Athens in 300 BC kept Scythian slaves to act as a police force. Police were not invented in the United States or to exclusively catch slaves (although they may have been used for that purpose just as Africans organized themselves to capture other Africans as slaves so they could sell rival tribes to the Europeans).
