In Buehler's photo the APD officer was coming to get Buehler, who was concerned for the safety of the female. Those police were clearly physically abusing a woman showing no sign of resisting as they forced her shoulder joints, an action which could potentially disable her for life.
Policemen receive training in safe takedowns. Both these officers, were clearly acting in accord and her safety safety & security.was compromised by the purposeful actions of the officers while in their custody.
There's a video on youtube showing Antonio having to be forceably arrested because he refused to comply with an officer who was attempting to arrest him. But I'll bet you already knew that.
(a) A person commits an offense if he intentionally prevents or obstructs a person he knows is a peace officer or a person acting in a peace officer's presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another.
(b) It is no defense to prosecution under this section that the arrest or search was unlawful.
I haven't seen a smear campaign by the cops trying to discredit Buehler. I have, however, seen many videos by Buehler and his friends trying to smear the officers. I have seen where the officer's numbers have been given out with instructions to harass them at home. If you want to know why the police and their friends are jerking Buehler around, look no further than the fact that Buehler and his friends have given up the moral high ground of "concerned citizens." Just My Opinion.
@faxdaddy The police smear campaign is the fake charges and court system. They have smeared Antonio's good name. The outcry against the police is a result of THEIR smears. Who drew first blood?
If the charges are fake, then this whole thing will end peacefully. I agree that, from just what I have seen, Antonio never spit in the officers face. I have my personal feelings on why the officer would make such a claim, but my opinion on that doesn't matter. I believe that charge will get dropped. However, there is a video circulating that CLEARLY shows Antonio resisting arrest. That charge is probably going to stick due to it being so well documented.
As I recall, from Antonio's own statement, he refused to comply with the arrest until they threatened to taze him. I would call that a written admission that he intended to resist arrest.
I'm sorry.. "Confession" was the word I was looking for. In Antonios statement, he wrote that he only complied with the arrest after they threatened to taze him. You don't get a better written confession of resisting arrest than that.
You're right that the police must answer for their actions. No one can argue that. However, the actions of the police do not excuse how we react to them. Antonio will have to answer for his actions as well.
BTW, Name calling is the first sign that you have nothing of value to say.
@faxdaddy I don't recall Antonio locking the police up in a cage, and inventing charges against them. The charges Antonio has made against the Officers is valid however. Police brutality, and official oppression.
And the police will have to answer for any wrong doing they did. I'm certainly not going to defend the actions of an officer who's in the wrong. If I had to guess, I would say that there will be a plea bargain offer made. The prosecutor will drop the felony "spitting" charge if Antonio agrees to plead guilty to the resisting arrest charge. Any charges against the officers will be dismissed by the judge.
The cops in this case are playing legal hardball, adding very serious charges to cover up their own abuse and misconduct. They took the lady passenger and added extra ridiculous charges against her. Bottom line, since they want to play this way, they need to face a consequence if they lose. They need to be charged with brutality, misconduct, false arrest. They need to be sued privately, fired and charged with felonies. Make them poster exhibits of why cops should not abuse their authority.
Fuck them..they need to release the video. If it shown in any way he was guilty it would have been on TV night one. mark my words..the video will disappear...
@MikeHansonArchives Can he sue for defamation of character, false arrest, assault, emotional distress or anything else. people need to start legally going after departments and officers PERSONALLY. Take their house, cars, or anything else when they CHOSE to violate people rights..
Why can't the media get it right, the woman the police roughed up was not the driver!!! How would the the dash cam interfere with the investigation? This guy has a right to the video for his defense!
@rolling422 So the cops and the district attorney are also alex jones disinfo actors? Ever considered that he MAY be associated with AJ, wanted to document the police, that "getting in the cops face" was an informed citizen exercising his rights and the cops roughed him up bc they got annoyed? Nope - you haven't - bc you live in denial Lala-land. You're the "conspiracy theorist nut".

(b) It is no defense to prosecution under this section that the arrest or search was unlawful.
In other words, even if you don't think you've done anythign wrong, you still must comply with an arrest. That's how the system works.

Straight from the Texas penal code.
Sec. 38.03. Resisting Arrest,
(a) A person commits an offense if he intentionally prevents or obstructs a person he knows is a peace officer or a person acting in a peace officer's presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another.
(b) It is no defense to prosecution under this section that the arrest or search was unlawful.

@faxdaddy You're an idiot. The APD gave up the moral high ground when they assaulted citizens and the charged them with crimes they never committed.
Stop your whining, two of your officers are going to go to jail for their crimes. Deal with it.
