I personally think that there is a lot of evidence to show government cooperation, certainly between Dutch security and FBI and the Indian Handler of this young man who was let free without interrogation. However, I agree with what you are saying. If you support the notion of Natural Rights, this man deserves a trial. If you don't accept this premise, than one has to accept that rights are given by the government and can be taken on a whim.

Is this man a suspected "criminal" or a "war combatant"? We can try to answer with a question, "has the US declared war"? No they have not. So assuming the Const. is still the supreme law of the land which requires a Declaration of War; we then are forced to conclude that he is a suspected "criminal". Suspects are indeed entitled to certain rights as spelled out in the Constitution. The fed govt has completely confuscated the issue by their refusal to follow the Constitution and Declare War.

The problem though is that we are conferring due process of law to a wartime enemy. Should our soldiers hold their fire until each and every enemy has had a fair trial on the battle field? If they are progressing towards our position, AK's in hand, should we hold a court and read them their miranda rights?
You are correct in that we can't just strip people of their rights, but when a non-US citizen is obviously attacking a the United States, we are justified and obligated to terminate them.

I'm not against punishing him if he is found guilty and I'm not 'sympathetic' to him. I'm sympathetic to my liberties and natural rights - as I am to yours. We don't know anything about this man or any other the gov't trots out for us to hate an condemn. Until he's tried, we don't even know if this particular man was on that plane or not. It's not a matter of being sympathetic to him - it's a matter of getting at the truth and making sure that all our rights are protected.
