There are no depth rules it's really all fair game. Dig a trench for sailboards or find shallow sandy water for the kites. Just as long as there isn't any ground contact(water on top of ice, ect). If you want an outright record then solid ground is the most consistent surface.

During Luderitz speed trials October 3-4 on Walvis Bay, Namibia were several 50Kn+ kiteboard speeds attainted...notably Alexandre Caizergues at 50.57 knots over 500 meters during abnormally powerful onshore winds. Intstantaneous speeds reached 58 knots. Amazing.
Woohoo! If I'm right, that's 56.1 mph!!! Has anyone gone faster than that under sail power?

Is there no rules about the depth of the water? Surely in shallow water you have an unfair advantage due to ground effect + lack of chop?

uh? the fact that the governing body of sailing tried to say that kiteboarding wasn't sailing? Using the wind=sailing.
They are probably upset after spending millions of dollars and waiting for 50 knots to be broken by some rich yachtsman..
and some surfer's turned kiters come along and break it with 2 grand worth of equipment. sorry folks. there's your proof right there.
