I'm not sure she's formulating it with enough clarity to make your point. She's just not adequately articulate. There is certainly some grey area there...as most clearly expressed by Justice Breyer's "symbolic religion" doctrine. But I'd doubt that she's got a clue what that is. That's she's taking a clumsy dig at the ACLU is without question, but neither she nor the fundamentalist right have any real grasp on what it means to live in a constitutional democracy.
