The US are rewriting the law. The geneva convention does not have anything about "unlawful combatants" so of course doesn't have a timeframe. Regardless of the Geneva convention he is still a human being and his treatment falls under international humanitarian law.

How would you feel if it happened to you? What if it turns out he's innocent? The charges they talk of now are "attempted murder". Doesn't seem like he's the huge threat to the civilised world as they are trying to make out. Why not release him and keep a close eye on him until a trial can be set?
I think you're missing the point. It's not whether he should be set free or not. His guilt or innoncence is a separate issue. It's his basic human rights and the right to a fair trial that are the issue. I don't understand why if some guy trained with terrorists he should not receive the same rights as a suspected rapist or pedophile would get.
I agree fjblue. Hicks sided with the enemy. He sought to fight along side terrorists, to train in terrorist camps, and he knew he had the option to leave Afghanistan after Sep 11 took place, but he did not. He made his bed as an unlawful combatant, and ignorance of the law is no excuse for him to be set free. If he wanted to be Australian, he should not have fought with our enemy. Suddenly he wants to be an Australian again, just to get out of trouble. Sorry, no sympathy here.

The American Government took their own detainees out to ensure their fair trial, why is it ok for an Australian to be subject to isolation, torture and removal of basic human rights?
The right to a fair trial was not being Squashed. The US canceled his trial to try to get rid of a legal loophole that would see dozens of known terrorists/supporters walk free. How many soldiers do you want to die at the hands of terrorists that we let walk free under the legislation they so eagerly seek to destroy?
