  • Yet another example of cops making laws up to suit there own whims. What the cop said about audio recording in public is ABSOLUTELY FALSE. As long as the person recording the audio is part of the conversation, he does NOT have to have the permission of the other individuals to record video or audio in public. The Supreme Court has also affirmed this and stated ruled that public audio and video recording is NOT a violation of wiretapping laws because it's not wiretapping! Imagine that...

Bible thumpers should not have the right to force their beliefs on you no matter if they do it on public or private property. It should be illegal for them to do that. Freedom of Religion should mean that you have the right to practice the beliefs you want to practice not the ones some streetside or door to door preacher wants you to practice. It's about time a cop brings these fools down a peg or two.

  • All universities have rules while on their campus. I know Michigan does. While a public university they have rules for where you can exorcize "free speech" on campus. You can be banned from University grounds. This is a dumb video and obviously the people filming don't know the rules and laws regarding this.

Conversations held in public, where anyone can over hear what is being said, are not protected by these wire tapping laws. The Supreme Court has already ruled on this. Audio and Video recording, in areas freely accessible to the public, is a right protected under the 1st amendment.

  • These campus officers are correct. The school can set rules to be followed within their area of responsibility and if you do not abide by those rules then you can be kicked out. And if you don't leave when asked, then you can be charged with trespassing. It's just like you can't go into a government building and do whatever you want, even though it's technically public property.

  • I am a Christian and Im all for the Gospel being preached everywhere, but the way the man in this video went about it was the wrong way. Brother, how do you suppose your message came across to those officers? There they sat trying to explain what was going on as you sat there and whined about your "rights." In some countries, you could've been killed right then and there for preaching. Respect God given authority, win them over with humility, not arrogance. Maybe then your message will be heard.

  • Do they receive federal funding? Probally, so go file a complaint with the Department of Justice, and Dept of Education this way they can be striped of federal funding. Courts have ruled that religious pamphlets rather it be Latter Day Saints, Watchtower, or other religious pamphlets that are offered free is not soliciting and therefore subject to the 1st admendment protections by Constitutional law. Wiretapping refers to recording a wire conservation, not a on street encounter.

I worked in law enforcement here in Ca and in intelligence gathering.They are Penn State campus police not city cops, they cannot pursue criminals off Penn state property. The officers all contradicted each other trying to guess if its public or private property, they dont even know! It is public property over which Penn State Univ has some rules which are recognized by the state of Penn. You are allowed to video & audio tape as long as all parties being taped are made aware of the fact they are being taped.   • "Wiretap" laws being used to arrest people recording police has been thrown out in every court - in public places, every court recognizes that nobody has a reasonable right to expect privacy, so wiretapping laws do not apply. Congress met a year ago to discuss and confirm exactly that.

Assuming the university here is ran on tuition it is also up to the management. Public or private you still need a permit to do what you wish. Public being that almost anyone can get a permit and private being at the discretion of the owner.

  • Wiretap laws are for instances of secretively intercepting voices, NOT in public when no one has no expectation of privacy. This is CRAP.

  • Penn State is a quasi-government agency as they are sponsored & funded by taxpayer dollars as well as a taxing agent. They cannot create rules impede with your rights as an American. Including your Freedom of Speech, Freedom of Religion AND consent is not required of any parties if the parties do not have a reasonable expectation of privacy for their non-electronic communication. See definition of “oral communication,” 18 Pa. Cons. Stat. § 5702.

  • @cav1967 the constitution and bill of rights does not state what you mention here, therefore it is not a law that need be followed. "fighting words clause" is not constitutional, so is not a law

  • The supreme court has ruled that in certain cases, it is constitutional to require protesters to register for permits for certain actions. Even if this were not true, you're blaming the officers for university policy. You try to trap them into saying something wrong in order to make them look bad. I'm definitely in favor of free speech, but you're trying to create a free speech problem where there isn't one.
