Generally some police academies are piss poor at educating LE on the law. It depends on jurisdiction. Granted, some open carry advocates are too zealous in confrontation with LE. CCW eases burdens on gun-carriers because it doesn't generate those pesky police calls, and you really have no means of ascertaining how LE will respond, whether you get an understandable officer or some Starsky and Hutch cop that takes his job too seriously. Open carry is best exercised in one's vehicle.

I think the police officer was very nice and didn't throw his weight around. Afterall, not many people go around with a handgun openly displayed so it is unusual. Personally, I prefered open carry to concealed carry but not many people want to be bothered with the hassle.
Common sense tells me that if I were an Officer I would be more suspicious if I thought you were concealing and didn't know whether you were licensed than I would if you were blatantly carrying out in the open.
I could understand if they had some shootings around there... It's just to protect themselves and others to detain the weapon until they double check with the law and make sure it IS legal. And, then, you're only required to produced that license (which may, or may not, be a form of ID) There is no law, anywhere in the U.S. that requires a person to even own ID, much less carry it with them, much less produce it on demand...

Secondly, you can not be detained without reasonable suspicion. It's very difficult to see from this video what could possibly constitute reasonable suspicion - if, in fact, it is legal to open carry in the area the video was taken in....

@YamahaWR200 Normally I would agree with you but in this case his firearm was taken and he was illegally searched so handing over his ID was really the only thing he could do. Although he should have stated that he doesn't coincide to searches and should have asked right away if he was being detained or if hes free to go. These things wont do much at the moment because the cop has no idea hes breaking the law but it will help in court if the person decides to take it that far.

So assuming Missouri has the same laws as most other states in regards to that, he legally did not have to identify himself. And they would have given him his gun back and he would have left. Cops need to make an effort to come to some sort of agreement in terms of open carry. People are always going to be weary of other people carrying guns. This isn't the wild west anymore and they WILL call the police, and the police HAVE to respond no matter what.

The common thread is that the activities being described are legal. If someone calls you and says they see someone doing something perfectly legal do you send a law enforcer to check it out? Charles county law, you are able to carry openly until you get a complaint from a citizen. at that point, you are causing a disturbance and are there fore in violation of the law. Just to let everyone know, even though the state of MO has open carry, a city or in this case an entire county can pass laws to prohibit open carry. In the city of stl, the law is referred to as "carrying a weapon in an unlocked container" and is a simple violation punishable by $100 fine (as told to me by District 3 Officers) . St. Charles County, has passed a law referred to as "Carrying a weapon in Detriment to the public" ( as told to me by a St. Charles County

To me, this video looks like a win-win. Civilians asserting their legal rights. Police officers maintaining professionalism throughout the entire ordeal. Tactically, open-carry defeats the possession of a gun for self-defense purposes. Except at a range and shooting games, a CCW holder should have the common sense to carry concealed. Although you have the right to carry openly in some States, that right does nothing to make others feel safe or keep YOU safe as a committed assailant would attack you with his/her full measure of force seeing that you have a weapon. Not having the element of surprise makes your weapon useless.
@PPQ9GUNNER Defense isn't the only reason to carry a weapon. A large part of the reason people open carry is to make a point of reminding the public that it is a right that exists. If a large amount of people open carried it would be no different than CC. Yes, an open weapon is not as effective as a concealed weapon in the even of a determined attacker but it is not useless as it can't be assumed that they will always realize it and shoot you first or that they will always be determined

Common sense tells me that if I were an Officer I would be more suspicious if I thought you were concealing and didn't know whether you were licensed than I would if you were blatantly carrying out in the open.

I could understand if they had some shootings around there... It's just to protect themselves and others to detain the weapon until they double check with the law and make sure it IS legal. And he was being pretty professional with it. He even said, if he was wrong, he would apologize to you guys. You guys handled it really well, too. I've seen people go ape sh!t over stuff like this.

What the officer did in this video was not only ILLEAGAL but violated their RIGHTS. NO, the officers are NOT free to confiscate your weapon UNLESS a crime has or is about to be commited. Citizen does NOT have to give the officer ANY info or show ID. The only thing the officer has a right to do under the law is to perform a 12031-e to verify the weapon is NOT loaded

YES, the officers ARE free to confiscate a weapon IF there is a possible threat or public concern, as long as the officer returns said weapon when everything is cleared up. Citizen. @TheWillBrooks You're never required to produce any documents of identification, at any time, anywhere in the U.S. - unless you're engaged in a regulated activity which requires a valid license on your person while engaged in that activity. And, then, you're only required to produced that license (which may, or may not, be a form of ID) There is no law, anywhere in the U.S. that requires a person to even own ID, much less carry it with them, much less produce it on demand...

@BloatedSensations ...you're required to verbally identify yourself, and that's it. That usually means telling the officer your full name and date of birth. Secondly, you can not be detained without reasonable suspicion. It's very difficult to see from this video what could possibly constitute reasonable suspicion - if, in fact, it is legal to open carry in the area the video was taken in....

@TheWillBrooks ...now, that's not to say the Officer committed some great transgression. No Police Officer knows all of the laws they operate under off by heart - that would be impossible. The Police often make honest mistakes, and the law allows for this - as long as the mistake was made honestly and they do not continue to act under their original mistake once they know they were mistaken. I will agree though that there was no violation of 4th amendment rights...

The police, having established reasonable suspicion and executed a lawful detainment are lawfully allowed to temporarily seize any potentially dangerous weapons for the duration of the detainment.

We need to thank God every day that we can even buy guns with all of the mass killings in the last decade. Other countries have banned guns after only ONE of these incidents. You don't need to try playing cop, lawyer, judge and jury here..just answer his questions and go on your lucky way, carrying openly. We can't do that in my state. You could live in CA.

@timeisupUS came out as a call, concerned person wants police to respond. One man had his gun taken for a few minutes while police veified he was not violating laws. then the gun was returned. Another was given a terry frisk to verify he was armed under what is called reasonable suspicion, and not disarmed because he was not violating law. (read case law jr terryvohio)

@m221201r I glanced at terry v ohio and the first thing i noticed is that the search is warented if the officer has a resonable suspicion that the suspect was presently dangerous. What did these ppl do that cause suspicion that they were dangerous. I dont believe exercising your right to carry a gun is reasonable suspicion that a person is dangerous.

@m221201r there were safeguards in terryvohio that would stop cops from abusing that power. I guess it would be up to a judge to decide wether the intrusion was waranted. personally I dont think so. I have had much dealing uninformed oathbreaking cops abusing their power. any time they want to harrass someone they can claim disorerly conduct and arrest someone if they dont like the tone of your voice. @YamahaWR200 Normally I would agree with you but in this case his firearm was taken and he was illegally searched so handing over his ID was really the only thing he could do. Although he should have stated that he doesn't coincide to searches and should have asked right away if he was being detained or if hes free to go. These things wont do much at the moment because the cop has no idea hes breaking the law but it will help in court if the person decides to take it that far.

So assuming Missouri has the same laws as most other states in regards to that, he legally did not have to identify himself. And they would have given him his gun back and he would have left. Or they would have arrested him, and he could go to court, sue, and win..

Cops need to make an effort to come to some sort of agreement in terms of open carry. People are always going to be weary of other people carrying guns. This isn't the wild west anymore and they WILL call the police, and the police HAVE to respond no matter what.

The common thread is that the activities being described are legal. If someone calls you and says they see someone doing something perfectly legal do you send a law enforcer to check it out? If you think law enforcement has to do these things, then you should check out NC, props to Raleigh, Garner, and Clayton PD for respect.

Basically with the st. Charles county law, you are able to carry openly until you get a complaint from a citizen. at that point, you are causing a disturbance and are there fore in violation of the law. I have personally carried openly in both st. charles and st. louis counties with no issues. in stead of wasting the cops time trying to get stopped, how about you start secretly taping the real crimes...like drug deals and murders and shootings from ppl with illegal guns

Just to let everyone know, even though the state of MO has open carry, a city or in this case an entire county can pass laws to prohibit open carry. In the city of stl, the law is referred to as "carrying a weapon in an unlocked container" and is a simple violation punishable by $100 fine (as told to me by District 3 Officers) . St. Charles County, has passed a law referred to as "Carrying a weapon in Detriment to the public" ( as told to me by a St. Charles County

If he cannot then the stop is unlawful and you can arrest him, just because he is a public servant doesn't mean that he is above the law. If you think this is bad then you should go to cali. To me, this video looks like a win-win. Civilians asserting their legal rights. Police officers maintaining professionalism throughout the entire ordeal. Come on cats, you can't expect patrol officers to know the law the way a lawyer may. Perfect world, maybe. If you guys wanna deal in absolutes, we could see the worst of people both ways. Tactically, open-carry defeats the possession of a gun for self-defense purposes. Except at a range and shooting games, a CCW holder should have the common sense to carry concealed. Although you have the right to carry openly in some States, that right does nothing to make others feel safe or keep YOU safe as a committed assailant would attack you with his/her full measure of force seeing that you have a weapon. Not having the element of surprise makes your weapon useless.

@PPQ9GUNNER Defense isn't the only reason to carry a weapon. A large part of the reason people open carry is to make a point of reminding the public that it is a right that exists. If a large amount of people open carried it would be no different than CC. Yes, an open weapon is not as effective as a concealed weapon in the even of a determined attacker but it is not useless as it can't be assumed that they will always realize it and shoot you first or that they will always be determined

I say open carry all day. What if your waiting for your permit or are in an area that doesn't easily give ccw permits? Just hope someone with a ccw or cop is nearby when your attacked? Criminals do not open carry. I never freak or really care when I see open carry. My first thought is usually "oh, that must be a good guy"

Get it through your heads OPEN CARRY CLOWNS is not normarl for regular people to see a civilian with a gun in a public street or anywhere people will call the cops cause they feel scared . they dont know if the person carrying the gun is a mental case or what? so for my safety and others i will always call the cops.

@parkerparkerm I find it odd a group of men want to walk through the city wearing guns. Takes a certain type of personality. Conceal it or find a better part of town to conduct your business. I shot someone about 15 years ago during a burglary at my home, no regrets, got what they deserved so trust me, I believe in the right to protect yourself. But how many people really need to walk around with a gun displayed on their hip? Especially a group of men all straped up. Just weird.
