How can Monsanto sue farmers who plant transgenic seed (claiming patent infringement), but organic farmers can't bring a class action suit against Monsanto for contaminating organic crops with GMO strains?
Even worse, once your crops have been contaminated, the patent-holder for that particular GMO (cough*MONSANTO*cough) can and will take legal action against you.
