There are two ways this could be avoided - neither is a very good solution: 1 - you could take the lane so that you are not obscured from his view, but that would only work if you knew he was approaching the intersection, and if you had room to move out into the lane (the car that passed you was going at a fair clip). 2 - you could have used a horn such as the AirZound, so that you could stop him before he pulled into you.
I had a car following already - the one that overtook, unsighting me from this driver - so taking a stronger primary position was out. I'm not into the AirZound, yes it would have alerted him that I was there but would it have changed the outcome? He was still asleep. (Plus I would have had to remember to pump it up... ;) )
At a guess I'd say he was concentrating on the car that overtook you. There's only a split second before the overtake in which you're visible to him. After the overtake he's committing to the turn already, but his far left position in the road after his turn indicates he has no idea you're there.

I got over any notion of kicking cars that cut me up about 15 years ago. It's pretty counter-productive really.
Besides, I ride with spd's and I only unclip when I need to.
