  • See, this cop could be an ok guy and a good cop but in this case he screwed up, he never told the guy he was being arrested before he tasered him, thats why they payed him the money, He then never said, "if you dont do as I say you will be tasered," before tasering him, then he lied to the next officer on the scene about what actually happened. The cop made a mistake with how he handled this and immediately knew it, thats why he lied on camera and why the state payed up so quickly.

  • At what point in time did the trooper put his hands on the suspect in order to indicate he was under arrest? Further to that, what was he to be charged with? While i agree all he had to do was fight the ticket in court, at no point in time was the troopers life at risk. Thats the bottom line.

And the law he broke depends on what laws are applicable in that jurisdiction. Obstructing legal process, disobeying a lawful order, ect. would be my guess though. In any event, the subject appeared as though he was attempting to return to his car. and then what? get a gun? run the officer over? he resisted. Period

  • This was NO life or death situation since the man was walking away from the officer. This stupid officer had NO LEGAL justifiatiion to use his taser. He should learn the laws of taser usage as explained by our country's highest court. Our supreme court states a taser is to be used as a non-lethal substitue for a gun. If the officer had no reason to shoot him with his gun, he had no right to use his taser. This cop is STUPID and a CRIMINAL. Lock him up!

  • Everybody needs to know our supreme court ruled that law enforcement officers can only use their tasers in a life or death situation. Since this man was NO threat to the officer, he should NOT have been shocked with a taser gun. He needs to sue this control freak cop. Get him fired for breaking the law.

  • If the suspect as he said believed the officer had a real gun, do you really believe he walk away. Not at all, and he also said he feared for his life. I didn't hear that in the video either. In that was the case, one wouldn't walk away. This could have been fought in court, not argued on the side of a highway. The officer was cleared of any wrong doing.

The point was that he was under arrest for refusing to sign, he became verbally combative and refused to comply to any orders. Trooper did the right thing.   • He wasn't very bright to expose his pregnant wife by not cooperating, then blaming the cop for putting them at risk. All he had to do was sign the ticket or choose to be arrested. He made poor decisions. The cop mishandled it by not talking things through and explaining things but if you don't comply and reach for your pockets, you are a fool and prepare to be tased!

  • Most law inforcement people are on giant ego trips. All one would have to do is watch the TV Show "Cops" and it should be apparant that their egos and sense of self protection out of controll. The cop explaining that this was ego on the part of the recipicant of the ticket is totally comical. He acted really scared to me. More like law inforcment terrorism to me.   • I watched the video. The guy who got tasered is an arrogant prick. He earned every volt. I have absolutely no tolerance for police brutality, but this just isn't police brutality at all. The guy refused to sign the ticket, then he resisted arrest and tried to leave. What did he think was going to happen? The thing to do was to just sign the ticket in the first place and have his day in court like anyone else.

  • The driver had a right to discuss the ticket, it became a challenge to the officer when he refused to sign the ticket. The officer should have just issued the ticket, however he commanded the driver to get out of his vehicle to arrest him, for not signing the ticket thats BULLSHIT! The officer had no legal right to make an arrest, the driver was never a threat, he was asking for his 5th Amendment Miranda Rights and the dumbass cop didn't even do that. FYI, I have a degree in Criminal Justice.

Challenging a ticket is not a right. The officer had every right to arrest the man for not signing the ticket as that is against the law. The cop can't just issue a ticket with out the ticket first being signed.

If you don't promise then he has to make sure you go by arresting you. But I do think the officer is a douche and handled it poorly and had no right to behave as he did. Also he failed to read him his rights. Case closed.

Whilst Australia's judicial system is too soft on offenders in most cases, America is too extreme to the opposite degree. I mean, really.....this guy was only speeding, he didn't deserve what he got. At the same time, the police also don't deserve to put up with non-compliance, they have a right to carry out their jobs efficiently and with no danger to themselves.

  • In a country where so many people have handguns and are prepared to use them then any officer is entitled to believe his life is threatened when someone he is arresting turns and walks away. You only need a quick check through youtube to see plenty of examples where cops are shot or innocent people injured by fleeing drivers because an officer held back rather than taking action.

    I cannot be sure this guy had to sign the ticket, but I am sure this was not police brutality, it was his own fault

    The point I was making though, was that while the guys back was turned he could be pulling a handgun out or returning to the car to get a handgun. I am just pleased to live in a country where such things are unheard of, rather than commonplace. The Police should have backed their Officer and fought the lawsuit.

What part of sign this ticket or step out of your vehicle would indicate to this person, "Re-enter your vehicle" or 'stick your hand in your pocket" Better yet why didn't he stop when he observed the taser? I cannot wait until you contact that uncooperative person and see what happens.

"Failing to sign the ticket, failing to stay outside the vehicle as ordered, and reaching into his pocket. Yeah I would say that shows the guy will come to court. Read the law before you open your mouth. The officer had the legal right to make an arrest at the point that the person failed to sign.

    The case has nothing to do with if the officer has the right to arrest Jared.

Why such a small settlement if the case is so clearly the officer's fault. Why not take it to court to get millions?     1.training in conflict resolution 101, the trooper was forced to take it.

    2.this was never a million dollar law suit, past cases of police abuses show you that.

    3.state attorneys offered to settle because they may lose a lot more in tax dollars, trying to defend this troopers actions with video evidence on the victim's side.

Don't you think that any attorney in the world would have told him to hold out or go for more in trial? Weak case and a deperate to settle. Plain and simple. In almost any slip and fall case you are offered a small settlement to go away. It is how things work. You are smart enough to understand that I hope.

  • @davejsmith They settled out of court idiot. The city saved themselves large legal fees in doing so. This is routine, but you would know that. If this case had real merit the settlement would have been declined and a extremely large one would have been sought by an attorney. You will fail as an officer. You might get a paycheck, but you will never have the ability to really do the job. Good luck to the officers that you back up or have to work with you. I will pray for them.

  • @davejsmith It does not matter if he wants to sign the ticket or not, he HAS to sign it, or go to jail. Signing a ticket is NOT an admission of guilt, only a promise to appear. When a police officer has already written a ticket, you CANNOT talk your way out of it. Just sign it, go on your way and then if you feel you have evidence proving you are not guilty, tell it to the judge.

Some cops are definitely on power trips and it goes to their head.This situation could have been defused in a more humane manner.Pretty obvious there was no threat if the cop took a second to listen to what the man was saying.     Consider this: The wife realizing her husbend is being harmed unjustly, possibly about to be killed, could have jumped on the cop in an attempt to save her family.   • I do understand that as a cop that is how you think, that is how you're trained to think and that process saves police officers' lives, but what police must learn is how to evaluate situations better. I'm not sure if this is an issue with the training that you receive.

  • If you're stupid enough to disobey/resist/threaten an officer you best be prepared to deal with the consequences.
