Or no because he did not test me or write it on my ticket?

@royjonesjr69 We do have a DataMaster...but .08 or above is DUAC, .05 to .08 is up to officer's discretion for DUI. If someone is driving like this girl, then can't count to four on her fingers, or cant walk a straight line, but blow a .06, then you will need the tape to prove to court she is unsafe to drive on the road. I had an instance where a girl wrecked into a house, but only blew a .06 and i charged her with DUI. If I hadn't had video of tests, then she wouldve gotten away with it.

@royjonesjr69 We do have a DataMaster...but .08 or above is DUAC, .05 to .08 is up to officer's discretion for DUI. If someone is driving like this girl, then can't count to four on her fingers, or cant walk a straight line, but blow a .06, then you will need the tape to prove to court she is unsafe to drive on the road. I had an instance where a girl wrecked into a house, but only blew a .06 and i charged her with DUI. If I hadn't had video of tests, then she wouldve gotten away with it.

why do ppl agree to do the sobriety test? just refuse and take the arrest they have no evidence against u tht way. ur still gonna lose ur license but u wont get a DUI on record

@silentcheese24 you say no they will say "probable cause" and go into an investigation. Just to prove you were drunk...Then you refuse they will still order/consider getting a blood sample. And if you still deny that the'll still charge you. Open container? charge. Unable to maintain roadway lanes? Charge...etc. So they will get you somehow...Believe me our great State Of NEW MEXICO is known notoriously for drunken driving as a whole...
