Maybe I missed something because I couldn't find part 1 but, I'd say that if the police take it upon themselves to try and enforce a rule that doesn't apply to someone and it blows up on them, then they (police) would be the liable party, considering that the corp (ICBC) doesn't have any 'interest' in it. However, if ICBC agrees with the police and TRY to claim some 'interest' on their behalf then they would be accepting the liability. Would ICBC step in shit following the police?
What you say jives with what I have observed. In Payroll, you have to declare a percentage of personal use with a company vehicle. CRA does not count the trip from you home to work as part of the mileage. Salesmen used to get around this by eating at a local restaurant and making a call, thus the rest of the trip to the office was covered under company purposes.
The CRA indirectly recognises the differences between travelling and driving in a motor vehicle for commercial purposes.

Take away those guns and fists and all the government has are words. Maybe we need to rethink all of the administrative remedies and set about educating the cops directly somehow. Of course the right to travel is always there but so long as the front line enforcers (cops) are kept ignorant we will continue to be shot, tasered, arrested, fined, humiliated etc...
So the D.O.T. are the only ones that should really be enforcing the MVA on commercial vehicles right? The cops should be sticking to being peace officers.

If the Police took the view that the actions of the ICBC were illegal then we would have no conflict. Clearly the Police do not take that view and are very aware of the implications to the public, yet continue to apply them.
MVA is also in existence within the UK. Use the technology the same way!

The MVA seems like a mistake , a unilateral error of a contract, the error is made by one party and the other party is aware of the mistake.
the MVA contract may be void ?

i think it is also the government's fault and the polices fault.
the government is allows the fraud
and the cops should be investigating it
unless no one has gone to the cops about it...
could the cops help by conducting an investigation... they could put an end to a fraud perpetrated on the people that they serve and protect...
and it's also icbc's fault.... should get the cops to look into it.
