@MrRicharon It is assault, however in the interests of accuracy we have to be absolutely certain when laying the allegation the officer was actually punched. It would be damaging to the officer to state in a court of law that contact was made when the video does not show this.

So you would have a video hidden away of the incident from another angle where the officer is punched in the face? Police photos of the officer's injuries? Maybe you are aware of some hidden law that means the officer should not have been charged with assault. Again, show us the evidence.

@zhroomking also i have to say for a person to be charged with obstruction they first have to obstruct the police, resisting,means you have to be placed under arrest 1st ,if they co operate in a calm and respectful manner to ascertain what their child is supposed to have done a majority of time they will be shown the same respect. Teenage boys have very high testosterone levels which makes them more prone to think they are invincible and above such mediocre requirements as following rules. They can be prone to act before thinking. A child of ten maybe charged with an offence if it can be proven that they know the difference between right and wrong. I hope will learn from this.

I was stating the use of force should be reasonable and proportionate. My concern is,had a parent or gaurdian stepped in and assisted the police the child would not have been in the position to be sprayed and the incident might have been avoided.It is best to diffuse a situation before it escilates.

@JRealkkk Hey mate, the internal investigation is done and as a result of the investigation the officer has been stood down and charged etc. As for how the video was upload, it was done straight from the phone onto my youtube account with no editing of any shape or form. I do know that many posters on here do get the Advocate newspaper but I posted it for the ones that don't live in TAS. I truly hope that justice will be served for this 12 yr-old child.

The officers pictured did NOT follow procedure and instead went straight to threatening and accusing and then pepper spraying a very upset and confused 12 yr-old... I DO NOT agree with the loud mouth that you can hear but regardless of the loud mouth this incident should never have happened! If the officer had taken the time to 'talk' with the child instead of being aggressive then the outcome may have been better.

You've got to love these phone videos, shot entirely from the perspective of their operator, what happened immediately prior to the recording? why were the Police called to the address to begin with? where the Police operating in a highly abusive hostile environment? It was NOT this child and they didn't even take the time to ask him. They pulled up in the drive and went straight to the bike "assuming they had the right person" and proceed to then pepper spray the young boy when he said NO leave my bike alone. The young boy now does not have any respect for the police which is very sad.

The constable has been assigned to non-operational duties and will not have .operational contact with the public pending the outcome of the court proceedings. Police conducted an internal investigation into the incident before referring the report to the office of the DPP. The constable will be charged by summons with two counts of common assault .

Teenage boys have very high testosterone levels which makes them more prone to think they are invincible and above such mediocre requirements as following rules. They can be prone to act before thinking. A child of ten maybe charged with an offence if it can be proven that they know the difference between right and wrong. I hope will learn from this.

The point I am making is that children are the responsibility of the parent or guardian and in most cases if parents have no respect for the law or those who enforce it, children tend to adopt the same negative attitude. @zhroomking I am well aware of the legal use of pepper spray I have worked in security. Protective duties and as a member of law enforcement . I was not saying the pepper spray was justified. I was stating the use of force should be reasonable and proportionate. My concern is,had a parent or gaurdian stepped in and assisted the police the child would not have been in the position to be sprayed and the incident might have been avoided.It is best to diffuse a situation before it escilates.

@JRealkkk Hey mate, the internal investigation is done and as a result of the investigation the officer has been stood down and charged etc. As for how the video was upload, it was done straight from the phone onto my youtube account with no editing of any shape or form. I do know that many posters on here do get the Advocate newspaper but I posted it for the ones that don't live in TAS. I truly hope that justice will be served for this 12 yr-old child.

The officers pictured did NOT follow procedure and instead went straight to threatening and accusing and then pepper spraying a very upset and confused 12 yr-old... @SpectralMyst The DPP have investigated and the officer has now been charged with 2 counts of assault and has been stood down. What happened was an abuse of power pure and simple. I DO NOT agree with the loud mouth that you can hear but regardless of the loud mouth this incident should never have happened! If the officer had taken the time to 'talk' with the child instead of being aggressive then the outcome may have been better.

@SpectralMyst It has NOT been edited, has now been proved after the DDP in TAS looked into it!! The officer was called to the area about a person riding the streets. It was NOT this child and they didn't even take the time to ask him. They pulled up in the drive and went straight to the bike "assuming they had the right person" and proceed to then pepper spray the young boy when he said NO leave my bike alone. The young boy now does not have any respect for the police which is very sad.
