Because there could not be interstate competition which would make their product more homogeneous,the very act at of being in a state gave them market power. How? The government mandated certain coverage in certain states. This led to states with insurance companies in the single digits. Also, the states mandated unnecessary coverage. I cannot purchase just catastrophe insurance if I pleased. In my state, women at the age of 60 have to purchase insurance relating to pregnancy...... lol

Of course, competition is needed. They should reduce interstate/ international restrictions. They should securitize insurance contracts so everyone in the world could add absorb the risk. This would make the insurance industry very close to a perfectly competitive. You want a government whom has no constraints on funding and who has no regard for inefficiencies to destroy the free market system. Fyi, economic illiterate, the long run economic profit for perfectly firms is equal to zero

This cap will cause a massive reduction in supply. ... do bread lines in the USSR ring a bell. If the healthcare bill is coupled with the cap and trade bill, this inefficient allocation of scarce resources will hurt the poor on a global scale. The stagflationary pressures will kill off 10s of millions of the poorest people in the world

Think about it. Portfolio Managers/ Investors can add this securities to their diversified portfolios. The will keep adding securities until all the idiosyncratic risk is diversified away (modern portfolio theory) because it would maximize their risk adjusted returns. Now people would be competing for these assets if they were not priced according to APT. Within an extremely short period of time, risk will be priced according to the systematic risk factors inherit in the asset.
