He will NEVER win this case. Wal-Mart's employee policy and employee handbook say that you can NOT fail a drug test. That includes marijuana. And he was made aware of that and signed a document agreeing with this policy to that effect when he was hired. End of story.  Too bad, because I feel really bad for him, and should he live to see the end of his trial, I would love to see him come out on top.

Of course Walmart is full of crap. I'm a liscenced med cannabis patient in Canada. I've been around since the early days of section 56 Health Canada ministerial exemptions. I use cannabis for severe arthritis pain and depression. I don't get "high" and I vaporize about every 1/2 hour i'm awake. The best I can hope for is rest, relaxation and decreased pain and spasms in my arms. I think i'll get a bumper sticker for my car that says "Wal-mart Sucks"!

The problem here is that many millions of people use marijuana just like people use alcohol. More people use alcohol because its legal. So you hear more about marijuana because people are mad because alcohol is more dangerous than alcohol but the MJ is illegal. Most people in America want to make MJ legal but if it was legalized many companies, police, etc., and more would be out of business. Prisons are not run by the government here. They are run by private companies.

I think you have a valid point that shouldn't simply be dismissed as as an idyllic, libertarian fantasy.

From the limited information I've acquired on this subject, the current law seems to protect against something called "handicap discrimination". To put it simply, if an employer hires someone with a pre-existing handicap, it is illegal for them to later terminate his employment based on that condition.

You and I are calling into question the efficacy of that policy.

This case is going to have a big impact on California as we are preparing for Prop.19 which will dicriminalize marijuana completely. I think this is going to be a big work place issue across the country since most major companies are still owned by little old grey haired conservatives.......

Well if that's the case, this man definitely has a case. It's ludicrous to think that he would pose a safety hazard to the workplace because of a doctor-prescribed medication which is administered only in the privacy of his own home.
