He will NEVER win this case. Wal-Mart's employee policy and employee handbook say that you can NOT fail a drug test. That includes marijuana. And he was made aware of that and signed a document agreeing with this policy to that effect when he was hired. End of story. Too bad, because I feel really bad for him, and should he live to see the end of his trial, I would love to see him come out on top.
I still can't believe that shit wal-Mart and the rest of corporate america can go to hell but us Americans will tuck our tails and let them fuck us like they have in the past wait till corporate America takes over the mmj movement it will really fucking suck
Of course Walmart is full of crap. I'm a liscenced med cannabis patient in Canada. I've been around since the early days of section 56 Health Canada ministerial exemptions. I use cannabis for severe arthritis pain and depression. I don't get "high" and I vaporize about every 1/2 hour i'm awake. The best I can hope for is rest, relaxation and decreased pain and spasms in my arms. I think i'll get a bumper sticker for my car that says "Wal-mart Sucks"!
false info! why would the USA ban a plant that naturally grows on this planet and try to kill all cannabis plants that grow naturally on this earth? cannabis is a herb that is grown on this earth from god. let this world be and let individuals make there own decisions.
I took a job for an american company based in Canada, they hired me first then asked me to take a drug test afterwards. I told them not on your friggin life and I'll take you to court if you fire me for refusing. The discussion ended there.
This is exactly why I donate to the ACLU and also why I dislike any politicians that ridicule the ACLU because they will help you fight for no cost too you, for your Rights as a Human Being given too you as our founders say, from our Creator!
The problem here is that many millions of people use marijuana just like people use alcohol. More people use alcohol because its legal. So you hear more about marijuana because people are mad because alcohol is more dangerous than alcohol but the MJ is illegal. Most people in America want to make MJ legal but if it was legalized many companies, police, etc., and more would be out of business. Prisons are not run by the government here. They are run by private companies.
I'm not convinced that he has legal grounds to win the lawsuit (especially since they didn't make the details of the suit clear in this report), but I do hope that everyone who hears about this will boycott Walmart.
Are you telling me that it's illegal for a business to terminate employment of someone who is incapable of doing their job effectively due to a physical condition?
If so, I really don't see why that SHOULD be illegal.
In any since.. are you defending Walmart?.. if so.. explain?
On what grounds does walmart have the right to fire this man for the treatment of his condition.. when that treatment HAS NOT effected his work productivity?
1) I'm not defending Walmart, I'm trying to understand whether or not this man has legal grounds for a lawsuit. You'll recall that I wrote, "I do hope that everyone who hears about this will boycott Walmart."
2) I haven't made the claim that this man's productivity was compromised by his handicap. I was asking a hypothetical question about the legality of terminating an employee based on a physical condition.
Bullshit! I understand if it's somebody smoking weed on site or on the job, but what people do outside the job is none of Walmart's business! This guy especially should be exempt from testing positive for weed! FUCK YOU WALMART! STICK MY SHIT AND PWQNAGE IN YOUR GREEDY CORPORATE PIPE AND SMOKE IT! X-)~
@sharinganclan213 Private business......being private...... works BOTH ways, that's the point you miss while claiming liberty is for us all.It is for us all and truly drug testing by employers should be outlawed, and I don't do drugs and can admit that fact of liberty for all.But walmart is guilty of discrimination of a medicaly handicapped employee and trying to usurp state law protecting the guy anyways, this dude should win easily without settling.
@aesthetictripp yes i agree, why does wal mart have the righ tto invade a person's privacy? Isn't that what the government is made for, to protect us, not invade our privacy by "law"
But the money to pay this man comes from someone else. That money is also private and should be spend the way the owner sees fit.
@sharinganclan213 Both walmart and the government have invaded our privacy, and all of these corporations should be tried under refreshed and just monopoly laws and dismantled,we the people have the right to be free and successful, but not at the extortion of the very document and people that protect that freedom. They have "too big to fails" when the reality is we have "too big to exist" It's Facism and not Freedom, walmart is a nation, not a "company" just like standard oil....
but politicians (Ron Paul included) seem to believe that "special groups" are who to listen to when running the country when they should be listening to we the people
There is no way we the people could be represented EQUALLY if we are forced to compete against such groups.. not even close!!
ironically each person of a corporation already has equal rights. & want to give them more =[
I think you have a valid point that shouldn't simply be dismissed as as an idyllic, libertarian fantasy.
From the limited information I've acquired on this subject, the current law seems to protect against something called "handicap discrimination". To put it simply, if an employer hires someone with a pre-existing handicap, it is illegal for them to later terminate his employment based on that condition.
You and I are calling into question the efficacy of that policy.
@Vinifera7 Walmart fired him over a safety issue, and all they to do is prove his performance on the job was a hazard to customers and employers. This case is going to have a big impact on California as we are preparing for Prop.19 which will dicriminalize marijuana completely. I think this is going to be a big work place issue across the country since most major companies are still owned by little old grey haired conservatives.......
Well if that's the case, this man definitely has a case. It's ludicrous to think that he would pose a safety hazard to the workplace because of a doctor-prescribed medication which is administered only in the privacy of his own home.
I wish Cali the best in efforts to legalize cannabis for recreational use, though they really dropped the ball with Prop 8...
@MattyTheMole Be Careful !!! There are many consevatives that smoke too. I personally know many so called liberals that are against marijuana use. I think its more a generation issue rather than a conservative / liberal isuue. FYI I am conservative & smoke & think it should be legalized.
@thewaybackmachine I can believe that. Obama smoked cannabis and now he turned his on the issue along with many other promises he vowed to fixed but lets face it so far America has yet to prove, to say the least, or produce a trust worthy politician. They just talk.......and talk....
@MattyTheMole Yes, They are a bunch of hypocrits, All of them... If the alcoholic beverage never existed & was invented today, do youy think the government would legalize it. NO WAY!! & it much more dangerous than weed. How many deaths in the U.S. everyday because of alcohol? Drunk driving, Liver disease, Domestic abuse... I can go on. The government has no logic...
He was in a low level management position yet was fired for lack being able to do his job safely?.. Who promoted him and why?? How convenient he couldnt do his job after testing positive.
I live in a free country where it is illegal for companies to sample your bodily fluids. Americans are little more than chattel, owned by corporations.
