Most restaurants in the UK and Europe bring the machine to the table so the customer never loses sight of his/her card. The card should be swiped by the owner not the waitress/waiter.
This is lame. What restaurant or business bring the machine out to the table? They always take the card away and bring it back...and yes, they can skim it at that time but they certainly don't need the skimmer around their ankle.
@JMS actually smart Card based credit cards are just as easy to clone, and yield an additional benefit for criminals. with your PIN they can take your credit card to an ATM and just draw out cash.
This is why "chip and pin" smart cards actually increased some of the levels of credit card fraud.
What about the usual waiter taking your card and bringing it back with your bill ,it can be scanned away from you? I never write my pin I just sign the receipt?

They tried me out for a dollar and then got me for $1500, the lowest limit, then they went for $2 and by this time I'd checked my statements before they went again. ANZ cancelled my card immediately. Inconvenient and a bit scary. The card has never left my sight.
make sure your card has a chip in it, if it does, do something to damage the magnetic strip, such as sanding it back with fine-sand paper
Once you've done that, stop using your pin and just sign for everything instead. For extra security, instead of signing the back of your credit card write "REQUIRES PHOTO ID AND SIGNATURE" in big bold letters.
card cloning is easy. Any clerk that you hand the card to can be cloning the card whenever it's magnetically swiped. They dont have to be hiding any weird devices on the person to do this. A hacked terminal is all it takes. That is why they invented the CHIP cards.

Mag stripe is not used with PIN.
PIN is used with CHIP (CHIP&PIN, makes sense right?)
and signature is used with mag stripe...
