I'm so sick of all the Toby Maguire comparisons. This is a different storyline with completely different characters, actors, writers, etc. It's a different interpretation of Spider-Man. There are tons of them out there, just because these two are a bit closer together time-wise than most doesn't mean one is worth any less than the other. A movie should stand on its own and not be judged against other movies. Don't judge it until you've seen it.
