No, it depends on what you do with it, it´s actually for backup games but most people download the games and put it on there. Music and movies works as well....

No, you can't go to jail unless you do illegal actions with it. It's ok to own one and use it to run applications that are legal. The video on the DS uses Moonshell which is a free application for DS flash cards. Now if you download and run illegal stuff that you don't have permission or the rights to you are breaking the law.
