Doesnt the reasonable suspicion argument get tossed out since the driver was parked on the side of the road WITH his window down? They just happens to pass him by and engage in conversation. @GruntStyle: Sitting in the driver's seat is not "operating" a vehicle. If it were, you could always get a seat belt ticket because you would not have your seat belt fastened the first moment you sat in your seat.
If it were truly a consensual encounter, he would be allowed to leave at any time. But since the officers told him he couldn't, they were detaining him. It is illegal to detain him unless they have at least reasonable suspicion of criminal involvement. Terry v. Ohio (S.Ct.)
@GruntStyle I had taken pictures of Boarder Patrol vehicle as it drove past me in a county park . Only one way out of park, when I left, B.P. pulled me over. I refused to hand over ID, B.P. would not give reason for the stop. He then called for backup, after backup arrived, is when they walked up to my right side window. They did then tell me I was being detained for taking pictures. I did tell them my name and address many times, main reason for editing. Thanks

I've been to america it is like a police state. They don't have the freedoms we are used to in Europe and the police can basically do anything they want. Some states offer more burden to the officers to have some evidence a crime has been committed or is in the process of being committed. The laws vary so check YOUR local state statues. Here in AZ citizens are not compelled to identify themselves or show ID unless an officer has evidence a crime has been, is being, or may be committed. They can request ID, but you dont have to show.

I think there was a time when just being able to take pictures in public wouldn't be viewed at all as suspicious by police. A time before people loaded up U-Hauls vans with explosives and used them to destroy buildings, or commercial airliners into them. They were well within their rights for requesting your ID, but they had no basis for an arrest, as you are correct in simply taking pictures wouldn't necessarily justify probably cause.

@1775novten: An example of an illegal photo is child pornography, or certain secure military installations (that you are not likely to get near enough to photograph anyway), or photos that are a clear violation of privacy (such as up-skirt photos).
@DavidForthoffer Which begs to question why he was even detained. When I asked the question about illegal photos, I was intending from public view. Anything from public view is legal to photograph. This detainment just seemed odd to me, because they didn't really ask any questions or investigate - they really just wanted his ID - that was it. I suspect it was to be put on some watch list.

For a while there after 9/11 police were arresting people for taking photos of federal buildings and airports, but the ACLU finely got a case in front of the Supreme Court who ruled that anything is public view was lawful to photograph. So I'm just going off supreme court case law.

@DavidForthoffer I'd have to agree with, I don't think any court would make a blanket statement that ever encompassed "everything". They usually just stick to specifically what's questioned in the lawsuit. The first one that comes to mind is Musumeci v. U.S. Department of Homeland Security, which was about photographing federal buildings from public view. There was another big one with the TSA - I'l have to find it.

U.S. Department of Homeland Security case involved noncommercial photography. "The lawsuit seeks a court order barring federal officials from harassing or arresting people engaged in noncommercial photography while standing in outdoor public areas near federal buildings."
@1775novten: Also, if you are taking photos only for your personal use, you do NOT have a First Amendment right to take those photos. States MAY pass laws criminalizing such conduct.
Lesson: If you are taking photos of e.g. police in public view, and a police officer asks why you are doing that, either decline to answer, or say it is for publication.

I've understood it that if you are photographing something for publication and/or advertisement where it is the intent to collect revenue from - that you have to have their permission. I've never heard of needing permission for personal use.
@1775novten: The 1st Amendment says, "Congress shall make no law ... abridging the freedom of ... the press". Courts have interpreted "the press" as referring to any one publshing information, which includes YouTube, blogs, etc.. So if that includes you, you have a 1st Amendment right to do that. But if you admit that you are recording somethign just for you, then you are not "the press" and do not have a constitutional right to record. States may then restrict your recordings.

I think the courts recognize that every citizen has the right to document events and not just permitted press agencies. I can't think of a single case where someone was convicted of a press related crime, simply because he was a private citizen as opposed to a press agent.

A court DID convict a videographer in such a case, where the videographer made the mistake of telling the officer that the recording was for personal, private use.

I think there was a time when just being able to take pictures in public wouldn't be viewed at all as suspicious by police. A time before people loaded up U-Hauls vans with explosives and used them to destroy buildings, or commercial airliners into them. They were well within their rights for requesting your ID, but they had no basis for an arrest, as you are correct in simply taking pictures wouldn't necessarily justify probably cause.

If you let your kids out in public where anyone can see them, how is someone taking pictures of them particularly different than someone looking at them and then drawing a picture of them?
And if your kids are doing something newsworthy, you should expect their pictures to be taken.
If you want your kids to avoid the public eye, keep them in private.

@1775novten: An example of an illegal photo is child pornography, or certain secure military installations (that you are not likely to get near enough to photograph anyway), or photos that are a clear violation of privacy (such as up-skirt photos).

@DavidForthoffer Which begs to question why he was even detained. When I asked the question about illegal photos, I was intending from public view. Anything from public view is legal to photograph. This detainment just seemed odd to me, because they didn't really ask any questions or investigate - they really just wanted his ID - that was it. I suspect it was to be put on some watch list.

If an upwind momentarily blows a woman's dress up in public view, it is still illegal to photograph it.
If certain secure military installations are in public view, it is still illegal to photograph it.

@DavidForthoffer I respectfully disagree with your example - except maybe the children. And even if it isn't illegal "technically", it shouldn't be done anyway.
When I was in the military, it was illegal for us to take pics of the aircraft from the flight-line, but we could take ten steps back behind the fence (perimeter) and then it was fine. Made no sense, but it was considered public view.

For a while there after 9/11 police were arresting people for taking photos of federal buildings and airports, but the ACLU finely got a case in front of the Supreme Court who ruled that anything is public view was lawful to photograph. So I'm just going off supreme court case law.

@DavidForthoffer I'd have to agree with, I don't think any court would make a blanket statement that ever encompassed "everything". They usually just stick to specifically what's questioned in the lawsuit. The first one that comes to mind is Musumeci v. U.S. Department of Homeland Security, which was about photographing federal buildings from public view. There was another big one with the TSA - I'l have to find it.

U.S. Department of Homeland Security case involved noncommercial photography. "The lawsuit seeks a court order barring federal officials from harassing or arresting people engaged in noncommercial photography while standing in outdoor public areas near federal buildings."

@1775novten: Also, if you are taking photos only for your personal use, you do NOT have a First Amendment right to take those photos. States MAY pass laws criminalizing such conduct.
Lesson: If you are taking photos of e.g. police in public view, and a police officer asks why you are doing that, either decline to answer, or say it is for publication.

@DavidForthoffer I've never heard of such a thing. If anything, I've always understood it as the opposite. I've understood it that if you are photographing something for publication and/or advertisement where it is the intent to collect revenue from - that you have to have their permission. I've never heard of needing permission for personal use.

@1775novten: The 1st Amendment says, "Congress shall make no law ... abridging the freedom of ... the press". Courts have interpreted "the press" as referring to any one publshing information, which includes YouTube, blogs, etc.. So if that includes you, you have a 1st Amendment right to do that. But if you admit that you are recording somethign just for you, then you are not "the press" and do not have a constitutional right to record. States may then restrict your recordings.

@DavidForthoffer I think the interpretation of press has grown beyond the formal press organizations. I think the courts recognize that every citizen has the right to document events and not just permitted press agencies. I can't think of a single case where someone was convicted of a press related crime, simply because he was a private citizen as opposed to a press agent.

@1775novten: The constitutional issue is not whether a photographer is a private citizen as opposed to a press agent. The issue is whether the purpose of the recordings is for private USE as opposed to publication.
A court DID convict a videographer in such a case, where the videographer made the mistake of telling the officer that the recording was for personal, private use.

@1775novten: It is not that you necessarily NEED permission for personal use. It is that states MAY criminalize such gathering of information. I recall reading a recent case where an appeals court upheld a conviction of a videotaper on just such grounds.

Those agents never once said that they suspected he was being unsafe, actually they never once claimed he was suspected of committing any crime. They just said they wanted his ID - for what? Just a suggestion, but "probable cause" doesn't mean anything at all. Probable cause of what? Big misconception with this, probable cause of murder? of theft? what? Great job trying to stand up for yourself, but really, u shouldn't have gave in (consented).
