  • Notice he didn't say "take him into custody" until AFTER he sat down. The judge was making a command to gain jurisdiction. He couldn't issue the "take him into custody" until after he had jurisdiction. Had he remained standing, things might have gone differently.

  • In a democracy no one should have that much power. I got arrest for asking a judge if i get sick would i be arrested. After that the huge bailiff kept getting in my face and pushing me out the door while i repeating stated, calmly, to him to stop harassing me. PEOPLE IF YOU JUST BELIEVE WHAT WE ARE TAUGHT IN SCHOOL YOUR IN FOR A BIG SURPRISE WHEN IT COMES TO JUSTICE! These alpha chimps are out of control.

  • Its pretty clear what happened. The guy started to sit, but heard his name. The judge wasn't asking him to stand as much as he was calling the case. The judge should have been more polite when saying to have a seat, but he was not, and its just unfortunate that some judges are rude.  When the judge said for him to sit down, even if it was rude, he should have sat without argument. He was just asking for trouble after that.

    I think everybody with common sense could hear that he was being passive in his voice while the judge kept on going: "Have a MOTHERFUCKIN' SEAT!!!". He represents what anybody else would've done in the same case. He doesn't necessarily know all the steps he has to follow in court. What he does know by instinct, like everybody else, is that when his name is called by the judge he reacts without hesitation. Judge abuses respect.

  • Agreed. The judge has to maintain control of the courtroom. Even though a minor issue, a judge should not have to constantly argue with a defendant about what to do. Many small violations can turn into disorder if enforcement is not swift and guarenteed. I bet he'll sit down next time.

The only people who do that are people who refuse to admit they did anything wrong and refuse to take responsibility for their choices and actions. And if I was in court, I wouldn't be stupid enough to challenge the judge. 3) This isn't even a case of a defendant saying yes or no at the right time. It's a case of a defendant openly defying the judge's orders.

  • The punishment must fit the crime committed and 30 days in jail was, in fact, the judge overstepping his boundaries. That guy needs to file numerous complaints against that judge and file a lawsuit if possible. These judges need to get over themselves and learn how to talk to people. I don't care what judge you are, you will not be yelling at me like i'm your child. You'll talk to me with some respect or get yelled back at.

  • I know from all the times i have been in a court room...when a Judge calls your name you half to stand...and as far as i can see he may have been thinking that the judge was just offering him a seat...and at first it seemed all he was doing looking back at the seat to make sure he didn't fall on his ass when sitting down

    When a judge walks into a room, people stand, after the judge sits down, then the people in the court sit down. I always thought this was done out of respect, not because it was a law. This is why people say, " Yes or No your honor" just as in monarchies people say your His/Her/Your/Their Highness.

    I guess that means not sitting down is considered contempt of court as it shows disrespect for the judge. I believe the judge should be required to state to the one approaching the bench

Judges hold a certain office/power to make rulings and decisions based on the facts of cases presented to them, and also have the power to administer "punishment" for crimes. My question to you is: How the hell do you NOT know this?

  • @beaterchew and where I live, it's considered disrespectful to be sitting while addressing the judge. You must stand when speaking to the judge, and the judge will get upset and cut you off if you attempt to talk to them while sitting.

    But this man was set up. There was already someone heading over to place him under arrest, before the judge had even ordered him to sit. So I'd like to know what he did to cause a court system to set him up in this way.

  • @beaterchew Theres a thing called principle, justice, standing up for whats right, etc... Nelson Mandela was one such guy, and he made a change. You're more like one of those 1930's Germans who didn't approve of what his government was doing, but wouldn't do anything about it.

    Now think if all of us did what the man in this video did, things would start to change, right? The fact that people don't for the reasons you describe gives the courts little reason to reform their dictatorship.

This person may have been testing their patience when appearing in court at other times. If you have ever been in a courtroom, you would know that judges have little patience for silliness and disrespect towards the court. and don't call me names.
