The extension of copyright laws in the US is largely attributable to Disney as they heavily rely on legacy IP, and whenever Mickey Mouse is bound to drift into the public domain you will see heavy lobbying to have the copyright extended.
Problem is that politicians repeatedly fail to handle copyright expiration on principle, but instead handle it on expediency. Micky Mouse should be in the public domain right now and Disney should rely on new characters/ideas to protect their standing.
Anyone smart in the realm of producing something like music would be safer if they took promises to pay based on samples of their music BEFORE they released their music into the public domain. (ofc once they had enough promises they would go around collecing payment from all those who promised, then release the material)
The absurdity is that this stuff (certain ideas) is actually considered property while ideas are relations that exist physically in peoples heads. So any claim on something I know is a claim on some part of my brain. Seeing as my brain is by definition MINE, I should be able to use it as I please. I shouldn't be sued for singing happy birthday on camera and posting it on the internet.
@MirageScience In Germany, people who have songs playing in the background of some YT videos have been sued by their version of ASCAP. Hell, even schools over there have been sued for having radios in the class room. IP these days is well beyond the intended purpose of the law.
@MirageScience I don't think IP law is legitimate for the same reason I think land ownership is not legitimate. It has to be conferred by an authority with force, rather than coming from the actual fruits of one's labor as property imo. So, it should be repealed entirely, but for the moment it would be just nice to have most of the nonsense repealed to pre-Berne Convention standards for a start.
@ladyattis now you have me very interested in what your position is conserning property in its entirety. So you see ownership of land as say an innitiation of force? Do you not belive in homesteading? I wouldn't suppose you would say land should be held by the public.
So to get at why you think IP law is illegitimate please me more as to you you see land ownership as illigetimate. Where you just saying a fiat land claim is illegitimate?
