The video clearly has the woman state that she asked the officer what he meant by "didn't answer the questions correctly" & the officer retold about the mother being from Mex.  Now, this man gave the police officer what he needed. What was the point of continuing with the conversation? Albeit, people should know their rights to remain silent.

  • @iammetx The law has not even been put into effect yet, officers are currently going extensive training on its implementation, and the specific incident of the "AZ trucker" is being investigated. That video isn't substantially clear on everything that happened as is most often the case with second and third hand relaying of events, and therefore we don't know the officer's frame of mind or reason for questioning at the time.

    I agree, though, for ANYONE... they should know their rights.

    Notice the terminology... it's "illegal" immigrant, not "unlawful" immigrant. Because there's no such thing as immigrating unlawfully.

  • @josda1000 it's not proving a negative, it's proving that you are legally and lawfully present - the same that is done for any workplace, event, theater, or venue. illegal immigration is just that - immigrating against the laws and procedures of the sovereign nation that has instituted rational, reasonable, measured rates for economic and social stability.

    If all of this is so rational, why are we coming more and more into a police state? With each passage of legislation, we see more "criminals" put into jail or kicked out of the country. We see things like these crazy SWAT raids, random searches at checkpoints, etc. You can't legislate morality, because it means that you trust government more than your fellow man.

  • @josda1000 since we're on the specific subject of legal vs illegal immigration, the federal laws regarding immigration are very rational, fair, measured, and reasonable. the federal gov't has failed in its duty to protect the border and enforce employment laws, however, which has allowed the magnet of illegal employment to grow out of control and is used by both parties for their own political purposes.

    AZ finally acted because of the fed gov't failure and negligence at their expense and harm.

The point everyone is raving about is the fact that a cop from AZ could pull you over if he believes he sees something "suspicious". This definitely puts ALL Mexicans and Latin Americans at risk for being profiled.

  • @checkunderyourbed read the dang law. something suspicious cannot be ethnic origin, color of skin, or race... the initial legal stop has to be for some other offense. what happens anywhere in the US when law enforcement stops you for an offense? you must provide valid ID. if you have none, they have a database. if there is no record of you whatsoever, then that would question your legal presence in the US and you'd be detained until it's determined. it mirrors the constitutional federal law.

They are, however, angry that the fed gov't has been so inept in performing its duties after the last amnesty in the last 1980's. Many are not interested in citizenship but only work, and travel back to Mexico to visit family. A sincere US Pres would meet w/Mexican Pres to push for reforms there & an end to corruption which harms the Mexican people, driving them to want to leave their own country.

  • @navson54 It's a huge problem for sure... I have friends in AZ, Texas, and Nogales and hear their first hand experiences. The misinformation, spreading of fallacies, and lack of context by interest groups and the media when discussing the AZ immigration law is completely irresponsible, however. It may turn out to have a valuable effect if it drives real immigration reform, or at least border and employment enforcement. The Fed requires of the states, but fails in its duties to them.

  • @navson54 Actually, illegal immigration is a condition created by allowing employers to hire illegally (which actually harms the undocumented worker even though they're making more than they would in Mexico, for ie), failing to manage a very porous border, and yet requiring states to provide public and social services to anyone regardless of their status. A recipe for disaster - and that's where we're at.

  • @brothermoon, you should "read the dang law"'s implications. The provisions for law enforcement officials can easily arouse suspicion among any racial minority group who has been profiled before. Provision 5, allows a law enforcement officer, without a warrant, to arrest a person if the officer has probable cause to believe that the person has committed any public offense that makes the person removable from the U.S. Any officer could use this "probable cause" excuse which isn't specifiable.

  • @checkunderyourbed Current law in almost every state allows law enforcement to arrest a person without a warrant when the officer has probable cause to believe that person has committed a crime. Probable cause must be based upon factual evidence and not on suspicion alone - that's basic law.

    A persons race CAN and IS part of a profile when law enforcement is making determinations - and that is not racial profiling because it's not the sole component of the profile.

  • @brothermoon The fact that racial profiles are in existence everywhere does not make it right. This legislation only creates a larger racial profile for all people of Latin descent. This factual evidence could be something as trivial as a large vehicle picking up Hispanics (a situation described in the law). This could be anything from a church picking up passengers in an unmarked church vehicle to simply a family loading up at a stop. It is now suspicious to ride in a van if you are Hispanic.

    There's a huge and distinct difference between racial profiling and a profile that contains race as one of the components but not the sole determining factor. Facts, figures, demographics, certainly are taken into account when making informed, rational decisions. Simply callling that 'racist' or 'racial profiling' is political correctness bs.

    The AZ law has so many safeguards against racial profiling as well as mirroring federal law that when properly trained officers will be able to arrest those who break the law and cannot provide valid ID proving their legal status.

  • @brothermoon I'm not being rare and ridiculous at all. All I am attacking are the "suspicious" types of activities outlined in the legislation. Remember it does not take a warrant or an actual crime being committed in order to be stopped. The suspicion could allow for a stop & search without a warrant. You could argue either way that any reasonable officer would not abuse this potential loophole but, we never will know what could happen.

  • @checkunderyourbed No it does not allow for a stop or search w/out a crime or misdemeanor being committed. It mirrors the federal law, as well as Special Order 40 of the LAPD, which are both Constitutional and just.

    Now sure there are corrupt police just like there are other corrupt officials, but the training and safeguards will make it very difficult for them to violate because they have to provide proof of conduct and probable cause, which cannot be suspicion by legal definition.

It's already customary for law enforcement to ask for identification when anyone matches a profile - this does nothing outside what the federal law and agreement 287g has had in place for years. Sensationalizing that is fear mongering without merit.

Even when it comes to driving you only get pulled over for a moving violation. This law allows people to be stopped for reasons other than that like oh let's say the color of their skin.   • @airborne373 You fail to understand that there is a difference between identifying yourself and proving your citizenship. A drivers license is not enough proof of citizenship, meaning that if you don't have your passport or your birth certificate or your alien card, you will be put in jail until you can provide them. If you agree with this law, you are now guilty until you can prove your innocence, a major violation of the supreme law of this country - the constitution.

Amazingly, Schwarzenegger's comment was not directed at SB 1070, but at the new proposal that any teachers with accents should lose their jobs and find alternate employment. Russell Pearce says these people are "illiterate on English". He needs to A. Learn the definition of illiterate and B. Learn the nuances of American Grammar.

  • @iammetx completely false. the law states that people legally stopped for some other reason must provide to law enforcement identification that states their status of presence in the US. a driver's license is not given to people who aren't legally present (citizens, visa holders, legal residents) and therefore qualifies as proof of status. this law mirrors the federal law on immigration enforcement, which is not unconstitutional.

I have heard stories of people being able to obtain a license, and I can personally testify having known someone who is now a legal resident alien, being able to obtain a legal Texas ID card while in the country illegally. If it weren't so, the BP wouldn't be asking me for a birth certificate along with my DL everytime I cross the international bridge. Besides, this law doesn't just affect those driving. You can be walking too.

  • @brothermoon That's not to mention immigrants who are adjusting status. During the process they have nothing to verify they are in adjustment. They can use a lawyers letter, but it is really up to law enforcement to decide whether they believe it legit or not. There have already been cases of a DL not being enough. Look it up on youtube. What forms "reasonable suspicion" that a person is an illegal? In Arizona, it's as simple as looking Mexican, regardless if you are American.

  • @iammetx There's a paper trail and database for immigrants who are adjusting status legally. For the rest of your points, this law is the same as Federal immigration law and is based on the same profiling methods - which is not discrimination, racism, or a violation of civil liberties. If the profiling was done merely on race, it would be a weak case as well as constitutionally questionable. Legal profiling is done all the time and works.
