  • After he spends $1000 to trademark your title simply put an asterisk after your title and keep going "legaly". If he does it again then get rid of the asterisk mark and put it in brackets....or get wild and put 2 asterisks. Its that simple. However this is assuming he is for real and this will happen.

Maybe someone did pay money to trademark it but they've most likey done nothing but waste their money. Even if a channel name is the same as a trademark I think the trademark holder would just have to work around it and come up with a youtube name that is not already taken. The only angle I could see them using is revenue from ads. Maybe turn the ads off, I don't know tbh....

  • @Montagraph To be more specific. Google can't just ask you to breach a contract when they became owners. Which they didn't, and couldn't. It's illegal. In turn, a 3rd party can't claim ownership of something they never owned.

You can't Trademark something when there's already a contract in place. I.E. you make a contract, when you make the account. -Worst case scenario, if I'm dead wrong, you could make a new channel and a video about this entire ordeal, and gain more subs than you've ever had. Because this is an interesting story.

I'm guessing that by having your Online persona trademarked, that would exclude you from being considered a personal user. However, since you are not the one trademarking your Online persona, the 3rd party that is in the process of trademarking your name is probably also somehow affiliated with Youtube's parent company (Google), and thus they are trying to control / censor you. 8(

  • Greetings, it is an old trick for a creep to find a sucessful name, business name, band name ect. that has not been registered as a dba or trademark in a state or country, register it under the creep's name and legally the creep owns it and can try and make you pay to use your own creation. I have paid from $22 to $85 to register the names of my projects. Several celebs do not own internet sites containing their names. Whoever called tipped you off.

  • They may be able to trademark the names. However, unless they used the names prior to you using them, you can challenge the trademark. Whether they can shut you down, will depend on whether or not you are willing to fight the trademark. It sounds unlikely that someone would go to that extreme. But you may want to consult with an attorney. Or trademark the name yourself. KEEP ON PREPPING

  • I don't think they can trademark a name somebody has already been using and then claim exclusive rights to it. Especially if they mentioned several names, therefore proving they had prior knowledge the names were already in use. In my opinion... they are full of shit.

It would then be up to the person who originally used the name to challenge the legality of the trademark. If it remains unchallenged it would be valid - and possibly enough to stop a youtube account. A similar situation happened with the CBS peacock logo.

  • i have this idea that it is hard to mess with. The earth is hollow. It has been strange for me to start thinking that. Has to be one or the other. Solid or hollow this means inner or concentric surface or no inner surface. Almost eveyone believes "solid" because of "authority" said so. The basic tactic to try to argue against the theory has to be abuse. What's the big deal unless it would alter the general perception of things, like heat or energy recovery.

The only reason those names have any value is because of the content produced by the persons with those names. Do ya see what I am getting at?   • PLUS, Trade Marking a Unique Logo is far easier than a "word" regardless of how creative it sounds. One of the requirements is to provide a graphic "exemplar" of the "mark" to be captured as Intellectual Property. When the USPTO sees a single printed word, it automatically goes through and extensive research process to protect those who may already be using the name.

    While "Patents" receive a temp. Pat. Pending number to begin manufacturing the product, Trade Marks have NO such temp. license.

  • Being awarded a "Trade Mark" is a long involved process that can take several years. They are not awarded easily. There are many hurdles to overcome ... look it up. It's costly as well and requires multiple hearings regarding the issuance of Trade Marks. Check out the packet of information that REQUIRES an Attorney (at some extensive cost) to file.

  • I've done a lot of Copyrights, several Trademarks and a few Patents myself. After I learned how to do it, I've been doing for myself since 1992. Now, the Trademark can be one of the most difficult to obtain, but it can be done. Trademarks can be more complicated than a patent because you have to demonstrate a lot. If you're Montagraph Inc, you'll have to show proof that your company and the Trademark are quite synonymous. The guy is completely full of shit and probably trying to tweak you.

  • you have lawful precedent as the owner of the name montegraph. and it has been officially recorded by your videos and the dates of the postings that precede any legal attempt to trademark. if he does do it which he may get away with, he will not be able to take any action against you as in a court of law he will lose as soon as you show the records and statistics from youtube. you will not even need a lawyer to defend this you can stand on your own in court and there is plenty of precedent.

Now there is the "STRAWMAN" idealogy that people declair their soveragnty and copyright their name, and use that as a weapon to evade taxes and forclosures. I would look into it if possible.   • The minute you begin using a name in any kind of "official or business capacity" you have Trademarked it.

    Registering a trademark is a different story but it is not necessary to register your trademarks.

    If you have an existing business name or real name or something, and someone else trademarks or uses the same or similar name, then you get into the legalities of it, but whoever had first use almost always wins.

    The first step in any litigation in this is a CEASE AND DESIST notice.

  • This is my opinion from what I have read and I too am not a trademark lawyer but I have done some research in the past.... This was done after you have been using this name for a long time so you would actually be able to file a trademark and take his stuff down. Seems like this is done to intimidate you and get you later on to pay some money. What I would do is file one as well and then have them research the trademark. You will have a longer term of use so they should award it to you.

Next, the last name thing is established and made pretty clear in monty's video its montagraph and demcad that are at issue. Finally, if your company doesn't trademark or tradename first your are s.o.l. If this were to become meaningful to the owners of the creative product later it would / could be an issue.

  • PRINCE changed his name into a symbol because the record label had rights to that name as you know we all could listen to his music just we had to seek it by saying the artists formerly known as Prince. He basically suceed from the label sucessfully the label could not touch his new earnings he offically changed his name and began earning money under another name. According to usptodotorg you have to be very speciffic as to what you intend to trademark. if they trademark it do like Prince did?

  • @cdltpx They will run out of money before you run out of names to call yourself then say the artists formerly known as Montagraph. Someone might have the money to do this but you can simply call yourself the artists formerly known as and there is nothing they can do about it.

  • @Talexa66 That or file the paperwork to protect your trademark it is a DIY project if you want to deal with it most will hire an attorney you could find a paraleagal that worked with that stuff they can offer you help but you are ultimately responsible for any errors. That way if you are really sucessful and decide to sell something with your brand on it they will not beat your to the punch with it but if you are on here as DC MGPH VH just sharing the news and views Y bother no real $ made.

  • @theylive1984rm You are right and wrong. Trade Marks are wholly different than copyrights. Trade Marks are akin to Patents. However, WORDS CAN BE TRADE MARKED. The proof of the "uniqueness" is a test that requests for "word" Trade Marks generally fail. Unique phrases are more readily "marked" ... but single words are unusual at best.

    Neither "COCA" or "COLA" is Trade Markable, while "COCA-COLA" has been granted a "TM". But ... that name was used 100 years ago...and was unique as a branded name.

Montagraph was published on youtube a public Forum so unless they can show they Originated it be for it was Published they will never get a Trademark unless they purchase it from the Inventor/creator, or are/were employed by the Applicant for Trademark to Create/invent
