found an article via google that states that the driver paid the $107 speeding ticket. i'm curious, how and when did the officer determine that the driver was speeding? there appears to be the orange 'road work' sign, then the 40 mph sign, but the police car is slowing down and moving to the shoulder to let the suv pass. is the police car equiped to tell if a car coming up from behind is speeding?

If he was going to ask anything, he SHOULD have asked to see the radar reading and the calibration date of said radar, instead of worrying if the sign really exists. If you are going to question authority, you need to know MORE than just enough to get your ass tasered! But, live and learn.
Many jurisdictions require that the officer allow you to see the radar. Don't press it if the officer says no because that's what a courtroom is for. But, at least ask, then ask a few more questions to show that you are watching.

Four full seconds went by with Driver's left hand out of view and his back to the Officer as the Driver walked away AND at the same time his right hand was reaching into his pocket.
Driver refused to comply with four clear commands to turn around.
Taser firing completely justified.

For Trooper Gardner's traffic stop to be legal he is required to factually predicate his exception to the warrant requirement in that (1) For a charge of violation of a speed provision under this part, the citation or information shall specify the: (a) speed at which the defendant is alleged to have operated a vehicle.(b) speed limit applicable to the section of the highway where the violation is alleged to have occurred.

It is wrong to torture a person, with the taser for a non violent motoring offence.He questions the robot policeman's sanity and discovers to his chagrin that he really is a robot policeman following the process...the safest thing for all of us is to take away this little torture device from the police. They have no regard for human suffering.

If this guy was walking away from police and not complying, the cop needs to arrest him. Without the taser, he could have wrestled him down, used a nice leg strike to the guys outside thigh, or just beat him down. This is much less humane then being tased. I've been tased. It sucks and hurts like a bitch, but it's much better then getting a good ass beating.
