  • Yes, and under Jim Crow you were free to marry anybody as long as it was someone of your own race.

    And no, the fantasy about homosexuality being a "choice" doesn't wash. Religion is a choice too; on that reasoning we should deep-six the tax breaks for churches.

  • You are equal citizens in this state. You have just as much a right to marry a person of the opposite sex as I do.

  • omg. omg. i'm SO fucking pissed. I live in san francisco. this is just ridiculous. Gay marriage shouldn't even be a question. EVERYONE HAS THE RIGHT TO MARRY. simple as that. if you go by the constitution, banning gay marriage is ILLEGAL. There are so many amendments that support gay marriage, in an indirect way. One of the amendments states that no one is allowed to get their rights taken away just because it isnt mentioned in the constitution. UGGGHHH. im sooooo mad right now.

  • Actually, the courts job isnt to protect the rights of minorities. The job of the court is to apply the law.

    California legally changed its constitution, and there was nothing the courts could have done about it, unless they were to exceed their power.

    This is why the founders did not create a democracy, and why the California proposistion system is flawed. Funny how progressives wanted it, but now it works against them.

  • California isn't set up like a republic (it was, but now its not). I don't see why I was down voted, I'm just pointing out the realities of the California Constitution.

    If your going to try to change something its better to be educated then ignorant of how the rule of law here works

    Personally,I don't even see why government is involved in marriage gay or straight, but I guess they know who to tax. o well

  • So, if I understand this right then it is now possible in California to take away the rights of any group you care to name so long as you have a majority in a referendum?
