The Arizona immigration law doesn't open up the door to racial profiling. How could it? Under the law, officers must be in lawful contact with someone before they can ask to see identification. That means you have to be in violation of the law before police can ask to see ID. Asking to see identification is a routine police procedure.
@MarmaladeINFP The law doesn't require people to carry their birth certificates around with them. That wouldn't make sense. Birth certificates wouldn't prove legal residency, since the birth certificates of naturalized immigrants would just show that they were born in a foreign country.
@scottvska I don't know what specific requirements the Arizona bill includes. What I was basing my statement on is a recent incident in Arizona. The police arrested an American apparently because he looked like an illegal immigrant (i.e., racial profiling). They wouldn't allow him to be released until his wife brought his birth certificate. I'm not sure why the police did this. He was a registered truck driver, but apparently the police didn't trust any of the documents he was carrying.
@MarmaladeINFP The incident you're referring to occurred on the 21st of April, two days before the immigration bill was signed into law by Jan Brewer. The customs agents (they were ICE agents, not cops) couldn't have been acting on the law.
@scottvska The report I heard said the officers were acting in response to the bill being discussed. The officials at that precise moment weren't required to act that way, but they chose to do so because of the anti-immigrant atmosphere surrounding the discussion of the bill. The incident showed how the law would be like once enacted. The point is that the action of those officials was unconstitutional as will be the actions of any official who acts on the new law.

Arizona doesn't issue driver's licenses to illegal aliens. If a foreign driver has an out of state license and he's in the country legally, officers can just check ICE databases to see if he's a naturalized citizen. If he's not a citizen and he's driving around without a visa (an incredibly stupid thing to do), then that could be probable cause for arrest. If he's native-born, then he all he has to furnish is some form of ID.
I'm a natural born US citizen. I don't carry around any identification other than a license. In fact, most people I know don't carry anything besides their license. I've only been stopped by a police officer once and all they asked for was my license. When I travel, airports don't require anything other than a license. Like most people, I don't have a passport because I've never travelled outside of the US. I have a social security card and a birth certificate, but I don't carry them with me.

@scottvska By blog entry, do you mean comment? Maybe I wrote something about voter suppression in Arizona, but I don't specifically recall. I have heard the argument before. Intimidation by police has in the past been used as a way of suppressing democracy. If a person in voting line is used to being harassed by officers who racially profile, that person might leave the line to avoid confrontation. Voter suppression based on race was used in Florida for example in a different way.
What the Arizona law does is to tell non-whites that they are not welcome there. Any non-white who lives in Arizona will be racially profiled and harassed. Many non-whites who are legal residents will choose to move to another state in order to avoid racial profiling and harassment. Since minorities tend to vote Democrat, this benefits the Republicans in Arizona who are supporting this law.

If it isn't used to racially profile and if it isn't used to stop innocent people, then it gives police no more power than present laws already give them. Without racial profiling, it would be completely ineffective.

It is superfluous. The only way it wouldn't be superfluous is if racial profiling is used, but that would be technically illegal and unconstitutional. It doesn't matter if it wasn't in their purview because it was already a part of the legal powers they hold. The only thing it changes is that a police officer potentially can have legal consequences if he doesn't ask for proof of residency for every person he interacts with which will be a massive waste of time.
The only way the police can avoid allegations of racial profiling is if they ask for legal documentation of every person they interact with no matter appearance or accent. This will cause the police to spend more time dealing with checking databases and less time doing other police work such as patrolling for criminals.

Police use criminal profiles to recognize someone who is (or might be) a suspect or wanted criminal. "Racial profiling" doesn't mean what you think it means. It doesn't mean stopping someone who hasn't broken the law solely on account of their race. That wouldn't help police fight crime.

If you have an eye witness who saw someone of a specific ethnicity, then you'd look for someone of a specific ethnicity. People aren't going to be arrested just for being mestizos.

In the US, midwestern accent is considered normal English and those with non-standard English tend to be minorities. Most Native Americans died before they even saw European settlers because diseases spread ahead of the advance of Europeans. So, it's a bit difficult to ascertain the exact number, but it can't be doubted that the number of Native Americans who were killed & died by disease & starvation was immense.

Because When my sister went to see what's wrong, the mexican was going to attack her but was lucky enough my mom(who is tomboyish) was there to stop him. Mom called the police, and they told us to wait at the gas station down the road. a couple hours later a cop comes to us and says that informed us he was an illegal immigrant. And has also informed us how many immigrants moved here(maui, hawaii) And how majority of them gets arrested for violence.

The Arizona immigration law doesn't open up the door to racial profiling. How could it? Under the law, officers must be in lawful contact with someone before they can ask to see identification. That means you have to be in violation of the law before police can ask to see ID. Asking to see identification is a routine police procedure.

@scottvska I don't know what specific requirements the Arizona bill includes. What I was basing my statement on is a recent incident in Arizona. The police arrested an American apparently because he looked like an illegal immigrant (i.e., racial profiling). They wouldn't allow him to be released until his wife brought his birth certificate. I'm not sure why the police did this. He was a registered truck driver, but apparently the police didn't trust any of the documents he was carrying.

The officials at that precise moment weren't required to act that way, but they chose to do so because of the anti-immigrant atmosphere surrounding the discussion of the bill. The incident showed how the law would be like once enacted. The point is that the action of those officials was unconstitutional as will be the actions of any official who acts on the new law.

Did it ever occur to you that ICE agents are federal agents, and operate under a separate jurisdiction than state and municipal police officers? The law doesn't give federal agents new powers. That really makes sense. Officers may ask for passports, but I doubt they'll ask for birth certificates. Arizona doesn't issue driver's licenses to illegal aliens. If a foreign driver has an out of state license and he's in the country legally, officers can just check ICE databases to see if he's a naturalized citizen. If he's not a citizen and he's driving around without a visa (an incredibly stupid thing to do), then that could be probable cause for arrest. If he's native-born, then he all he has to furnish is some form of ID.

I'm a natural born US citizen. I don't carry around any identification other than a license. In fact, most people I know don't carry anything besides their license. I've only been stopped by a police officer once and all they asked for was my license. When I travel, airports don't require anything other than a license. Like most people, I don't have a passport because I've never travelled outside of the US. I have a social security card and a birth certificate, but I don't carry them with me.

Intimidation by police has in the past been used as a way of suppressing democracy. If a person in voting line is used to being harassed by officers who racially profile, that person might leave the line to avoid confrontation. Voter suppression based on race was used in Florida for example in a different way.

What the Arizona law does is to tell non-whites that they are not welcome there. Any non-white who lives in Arizona will be racially profiled and harassed. Many non-whites who are legal residents will choose to move to another state in order to avoid racial profiling and harassment. Since minorities tend to vote Democrat, this benefits the Republicans in Arizona who are supporting this law.

I realize the law says otherwise, but legalese and practical reality don't always correspond. The law is actually pointless. If it isn't used to racially profile and if it isn't used to stop innocent people, then it gives police no more power than present laws already give them. Without racial profiling, it would be completely ineffective.

It is superfluous. The only way it wouldn't be superfluous is if racial profiling is used, but that would be technically illegal and unconstitutional. It doesn't matter if it wasn't in their purview because it was already a part of the legal powers they hold. The only thing it changes is that a police officer potentially can have legal consequences if he doesn't ask for proof of residency for every person he interacts with which will be a massive waste of time.

You're assuming the law is designed to stop illegal immigration in toto. It's not. It's aimed at reducing illegal immigration in Arizona. An illegal immigrant with a New Mexico driver's license might not be arrested. If he has a valid driver's license, it's presumed that he's in the country legally, even though he isn't.

Police use criminal profiles to recognize someone who is (or might be) a suspect or wanted criminal. "Racial profiling" doesn't mean what you think it means. It doesn't mean stopping someone who hasn't broken the law solely on account of their race. That wouldn't help police fight crime.

If you have an eye witness who saw someone of a specific ethnicity, then you'd look for someone of a specific ethnicity. A caucasian driving with tinted windows may look like a mestizo from a distance. If police pull over an unlicensed driver (misdemeanor offense) speaking garbled English, with no form of ID on his person, then that could be probable cause for arrest. People aren't going to be arrested just for being mestizos.

In the US, midwestern accent is considered normal English and those with non-standard English tend to be minorities. If the police profile based on garbled English, that is a textbook example of racial profiling.

Alyona is great! Immigrants are the backbone of the U.S. economy and this has been true for over 100 years. Immigrants contribute, pay taxes, work hard so that we have cheap food and housing. The state governments can't balance their books because of their own incompetence & everyone blames the immigrants.

Many illegal aliens would like to be legal immigrants and many illegal immigrants have families and children who are legal residents. They pay taxes because they want to support the govt that helps support them. Many illegal immigrants and legal residents who are children of illegal immigrants use public services (eg schools) and emergency services (eg medical).

@raultalbot7 All it takes to pay taxes is to send money to the IRS. You don't need an SS #. The IRS won't refuse any money sent to them. The IRS doesn't really care if tax money is coming from a legal resident or an illegal immigrant. All the IRS cares about is making sure everyone living in the US is paying taxes. Some illegal immigrants even own and operate businesses in the US. Most officials simply don't care as long as they're following the law and contributing positively to society.

"Everyone" pays sales tax. "Everyone" pays property tax (indirectly if you rent). Most illegal immigrants who work in factories use fake social security numbers and pay income tax as withholdings. Do you think illegals file tax returns? No. University of Nebraska study found that U.S. citizens pay less and receive more services from gov't than illegals.

@rubberbaby00 ...I read the report. It fails to factor in crime and jails into the cost for taxpayers. The reason they didn't cost more is, being illegal, they can't get all the services. Make them legal watch the costs explode. The report also failed to factor in wage losses and depressed wage rates to other workers. Wages have all but fallen in the very industries they enter. It failed to separate legal from illegal immigrants. This study was done only on the state of Nebraska...not the US.

It was inhabited by scattered indian tribes who weren't united under some pan-indian nation (they battled each other). It was not a nation-state with immigration laws like the US.

Also, Native Americans still are legally considered independent nations and different laws apply to Native American nations. W/in the US, states make different laws. So, even in the US, there isn't a unified legal structure, culture and language.

@MarmaladeINFP America's judicial structure is laid out in the Constitution. The presumption that criminals are innocent until proven guilty (for example) holds in every US state. The fact that US states make different laws doesn't change the country's Anglo-Saxon legal structure. And if indian reservation are independent nations (they really aren't - they're subject to federal law), then they're not part of America.

I obviously wasn't claiming that indian tribes "don't count" or that they're less important than other nations. My comment was that nation-states, like America, are an entirely different type of entity than the tribal chiefdoms that existed in pre-colonial times. Pre-colonial America wasn't a nation-state will immigration laws, and so the original European settlers weren't "illegal immigrants." Take your schizophrenia pills and leave the rest of us non-paranoid, non-psychotics alone.

In particular, some US industrialists in the past funded and advised fascists govts in Mexico. The reason Mexico is controlled by drug cartels is because of our War on Drugs which has only succeeded in increasing crime and imprisonment rates.

@MarmaladeINFP Mexico has never had a fascist government. There was a fascist party in Mexico in the 30s, but they never reached power. FYI, fascism and democracy aren't mutually exclusive. E.g., Hitler was elected by a popular majority and free elections were held under some fascist governments. If Mexico is corrupt, then the people living there must, at some level, be corrupt themselves and thus be responsible for their country's corruption.

@scottvska Whether Mexican govt is or ever has been fascist depends on how you define fascism. Mexico certainly has at least been corporatist which some define as soft fascism. Soft fascism & democracy aren't necessarily mutually exclusive (pure, absolute ideologies don't exist in reality), but fascism only remains 'soft' as long as democracy actually functions. In Germany, democracy stopped functioning. Blaming the victims of corruption & oppression is morally degenerate.

@BlessedForLyfe Let me just correct you on a minor point. Some scholars put the original number of Native Americans in the hundreds of millions. Most Native Americans died before they even saw European settlers because diseases spread ahead of the advance of Europeans. So, it's a bit difficult to ascertain the exact number, but it can't be doubted that the number of Native Americans who were killed & died by disease & starvation was immense.

The wealthy elite in the US didn't want Mexico to be a democracy. Mexico exists today because of US intervention. This law in Arizona is a democratically passed law, supported by the people of the state. It doesn't matter if it's a "Murder of mexicans is now legal" law. It's their land; their law.
Astute legal immigrants will carry their papers or even announce themselves to the sheriff's offices.
