The 22nd Amendment says that the presidency shifts at noon on January 20, so Obama become president several minutes before he swore the oath. The new president is required to swear the oath by the Constitution, but the transition of power is not contingent on the oath.
I think Biden would have been considered acting president during the minutes after noon but before Obama swore the oath.

The 22nd Amendment says that the presidency shifts at noon on January 20, so Obama become president several minutes before he swore the oath. The new president is required to swear the oath by the Constitution, but the transition of power is not contingent on the oath.
I think Biden would have been considered acting president during the minutes after noon but before Obama swore the oath.
