There is nothing in your constitution to say the president can't employ forces. As commander-in-chief he also commands the military. The War Powers Act is what accomplishes the neutering of power, and it's considered by most to be in violation of the constitution- which is why almost every president since it was formed (Vietnam, anyone?) has gone against it.
Confusing the matter is the modern definition of war, which requires a declaration. No such declaration has been made regarding Libya.

@masercot Well i thought that be enough to help see that libya was going thru a civil war. Rather than do the copy n paste thing i did before. The difference is civil is a war within its self to change parts of the government. Sometimes seperation does happen with it. Revolution is to break off n change everything. Its commonly confused with each other the sites all around say it as well. The difference arent huge n I can see why you said its a revolution. Even i had to double check. Sorry didnt

@masercot The south was not trying to take the north. They just wanted the USA to get out of their territory, and yes it was THEIR territory. There is nothing in the constitution which prevents states from leaving the Union. Lincoln should have pulled his troops out of foreign territory if he did not want war.
