the 2nd amendment can be interpreted a number of ways because the language of it is rather vague. When Heller came out, they also overturned years of precedent because Scalia interpreted it to mean that it would apply to more than just the militia...so "destroying" the 2nd amendment can be a number of things. there is no straightforward interpretation.

Sotomayor and her colleages made a flippant decision on the New Haven firefighters case. This case had huge national implications and it basically was a matter of constitutional law. The court decided it on narrow statutory grounds and ignored the constitutional questions. Result: White and one Hispanic firefighter could not be promoted because no black firefighter passed the test. This is ridiculous. BTW, Wash. DC's paramedics are notoriously incompetent. No doubt affirmative action there too.

I personally do not want to see the court judge with their hearts. I want them to judge with their heads. That is the point of having a rule of law. If they judge out of emotion (empathy, as you put it) the courts will be subject to the wild ebbs and flows of the prevailing emotional climate of the day. This is dangerous on so many levels.
