I would just like to say...Since when did people start thinking talking in the theater or using the cellphone is their right. It's a priviledge, even if you paid for it. Life, liberty, free speech and property are a few of your rights, not watching a movie. If you behave as an inconvenience to the majority of the movie goers, you lose the 'priviledge' to watch the movie. This concept can and should be applied to a lot of other things. plain and simple.

Customers pay $6 or more to watch a movie, and they expect to enjoy it without any interruptions.

So that is why I tell people if you want to yell at a company, do it over the phone. If I am calmly sitting in my seat texting and a manager harasses me, all I would do is call the cops. @mchambone Acutally I have only called 911 for ambulances and medical emergency. Most of the time I call non-emergency numbers for the police. My neighbors dog barked all the time and would stop when you yelled at it. The neighbor said stop yelling at his dog.. LOL so then I started calling the police, after 4 citations and a judge telling him he is facing jail time if it happens once more. They got rid of the dog. Hopefully he has a better home and a better owner.

Most of the cops told him to keep the dog inside, he didn't On top of it the cops told me he had an outstanding warrant so when the wrote him his first citation he got arrested on top of it. After that he came to my house and wanted to fight. I told him to grow up and go away. he did.

I would just like to say...Since when did people start thinking talking in the theater or using the cellphone is their right. It's a priviledge, even if you paid for it. Life, liberty, free speech and property are a few of your rights, not watching a movie. If you behave as an inconvenience to the majority of the movie goers, you lose the 'priviledge' to watch the movie. This concept can and should be applied to a lot of other things. plain and simple.

@whoo689 It is a theatre, yes. They also serve beer and food -- so yes, there is waitstaff. But they operate silently -- you write your order on a slip, and they slip in and out quickly and quietly.

You're blatantly lying about your cop friend. As someone who's actually been through a police academy and currently manages a retail establishment I can say this about trespassing.
It doesn't matter what you're doing. Annoying a cashier, talking in a movie, peeing in the aisle or planking in front of the doors. If the owner or manager on duty decides it's time for you to go, you are trespassed. Period, end of story. There is no burden of proof to trespass someone.

So you went through the academy, and you are working retail???? huh.. care to explain that? were you such a super cop after the academy that you decided to go into retail? how long were you a cop? How many trespassing calls did you respond to. A retail spot can call the cops for trespassing, I said that many times, but my cop friend said he would not consider texting in a theater a public nuisance. And would not cite the person or remove them.

@MichaelMantion Yep, I did go to the academy and I work retail. I've driven nothing but 4 cylinder FR drive cars with no power steering and when we got to the driving portion of the academy I had to drive a Crown Vic. I failed the driving and I'm ok with that. I could go back and finish anytime I want but I have bills to pay and a family to feed. It doesn't change the fact that it doesn't matter if it's a public nuisance or not. @cactus337 If I bought a ticket its not trespassing. If I break some other law then the police can arrest me but the theater can't detain me physically or they would be breaking the law. By your logic the theater could sell everyone a ticket, 2 minutes in ask everyone to leave, then have another showing.. they can ask me to leave, I can tell them i have a ticket don't bother me, they can then call the cops, that's it I enjoy the movie go home with out issue.

@MichaelMantion Sorry sweetie, but any establishment has the right to refuse service to anyone. If the staff sees that you are being very disruptive and preventing the other customers from having an enjoyable movie experience, that staff has the right to kick you out. This is coming from someone who used to work in a movie theater, and had to kick people out on more than one occasion. Customers pay $6 or more to watch a movie, and they expect to enjoy it without any interruptions.

If they deem the behavior disruptive & give you advance warning of what they consider disruptive, they have every right to kick you out. @Aggiesgigem absolutely. If I am in the movie theater after the movie I paid for is over, its time to leave, its implied when the ticket was bought. Look if its a mall, and I am causing a disturbance, that could be trespassing, if its a parking lot and I am hanging out, it could be loitering and trespassing. If I am talking in a movie and he manager wants me to leave and I stay to the end of the movie, not trespassing. I am sure a cop can still give a ticket, but it would pass in court.

Thing is I talked to a deputy sheriff friend of mine from years ago, it was good to catch up, I wanted to know if I texted in a theater if they could kick me out. He said they could ask me to leave but that is about it, If I wasn't making a disturbance the cops can't get involved. You seem to imply that they for any reason can ask me to leave and its trespassing.. definitely conflicting. He did say if you sneak into a theater its trespassing.

Basically if you pay for the ticket it is implied you will see the movie, they can't just kick you out for what ever reason a posted sign is no different then someone telling you something. IF an employee tells me to bark like a dog or get out, I don't have to do it. My cop friend says for it to be trespassing a person would have to be disruptive, he said texting in a theater is not disruptive

So that is why I tell people if you want to yell at a company, do it over the phone. If I am calmly sitting in my seat texting and a manager harasses me, all I would do is call the cops. A company can ask you something once, if you tell them to leave you alone, that you feel intimidated or harassed, they have to stop.

@mchambone Acutally I have only called 911 for ambulances and medical emergency. Most of the time I call non-emergency numbers for the police. My neighbors dog barked all the time and would stop when you yelled at it. The neighbor said stop yelling at his dog.. LOL so then I started calling the police, after 4 citations and a judge telling him he is facing jail time if it happens once more. They got rid of the dog. Hopefully he has a better home and a better owner.

@SaintBrown852 Actually many of the neighbors called the cops, one person had a lawyer and was building a cause for a law suite. I didn't call the cops until he told me not to yell at his dog. Most of the cops told him to keep the dog inside, he didn't On top of it the cops told me he had an outstanding warrant so when the wrote him his first citation he got arrested on top of it. After that he came to my house and wanted to fight. I told him to grow up and go away. he did.

By making noise, you have violated your piece of the civic contract. You can also be forced to vacate a restaurant, gym, museum, or retail shop, and more. Probably not, because if they were, they could have contacted the manager, and he would have told you to leave and never come back for breaking the store's rules. After the laws, they have every right to make any rule. It's a private business, and they can serve anyone they want to. People can and will try to tell you to do things all the time. What they tell you is not law. Laws are typically written by elected officials. The cops were called on me, but there was nothing they could do for the person I threw out. That's 100% of the time, too. You use your phone at a gas pump, you actually put yourself at risk for igniting a fire. Highly unlikely, but it can happen. There's a reason for the rule, you should follow it, unless you're dialing 911.

Absolutely the cops would not ticket a manger for harassment for calmly trying to enforce policy. In most cases managers will simply lie about what happened to have people removed. BTW only an idiot thinks a cell phone is a fire risk at a gas station. The voltages, amps and sealed nature of the electronics make it perfectly safe.

Example: The sign on the door of a business says, "Please remove any hats, caps, etc. before entering this establishment." You have a hat on. But you don't take it off, even after the warning. The manager asks you to take the hat off or you must leave. Do you leave it on? The rule may be fucked to you, but not to the owner. If you don't like it, leave, or be made to.
And you're very naive if you think ANYTHING is perfectly safe.
