In this particular case, there's a clause in the law about "is or appears to be" a certain age. This girl doesn't look 14 or 15 and there are other circumstances involved like, what the hell was an underage girl doing at a club? If the guy has a history of chasing underage girls, that's different. You throw the book at him. But if his criminal history doesn't suggest any indecent behaviour with underage girls, it's hard to blame the guy. You're allowed to have whats called Ignorance of Fact.
