from your post, i would guess that he benefits from a huge adrenaline dump. also, if your workouts consist of traditional weightlifting exercises, then it probably is adversely affecting your hand speed. practicing grappling rather than punching would probably benefit you.
i dont weight train, i use bodyweight and have some weight fo exercises that are too easy. i have fast hand speed. and people have told me that u fight better if u relax.
He wants to hurt you. You don't really want to hurt him, you just want to be defending yourself. So I'm guessing he has a little more fire behind his attacks. Like someone else mentioned, it may be best to try and redirect his energy and let gravity do the work.
You just gotta get pissed off, dont worry about hurting them. Its their fault if you do, plus if you do he may fuck off. Think about your fights, if the other guy knows how to fight and you make a dumb move he will catch you on it.

I agree with all this accept the part where you turn and strangle him. You may have some difficulties explaining the necessity for using lethal force once you've removed the assailant's ability to inflict lethal force. Remember the assailant must have the ABILITY, the OPPORTUNITY and you must be in immediate JEOPARDY. If you take away any of these you will have a hard time justifying lethal force (strangulation is considered lethal force).

One thing I'd like to add that I've learned from tang soo do is to tuck your chin as soon as the attacker grabs the neck this can protect the cartlidge in the throat from being crushed. It takes less force to crush a soda can than your trachea.

The man was dropped of all charges. He wasn't even attacked a choke like this isn't meant to do any thing but hurt/kill.

It would depend on ths situation. 2 points:
1) You really need to know your local, state, and federal laws because they can differ depending on the situation and location.
2) You had better be able to defend yourself in court for ALL actions you make and rest assured they will ask why you didn't run.
