In Detroit which is one of the most predominantly black cities in the USA, the black dispatchers identify race of potential perps to the black officers as a matter of procedure. So am I to assume all these blacks are racist? I hope not. When we roll up on a scene often there are numerous people and we need to know ASAP who the potential aggressor or criminal is, just in case violence becomes an issue. This is in FACT for the safety for all involved including the possible Perp.

He arrives at the scene and comes to a man who identifies himself as owner of house with valid license. Okay...check, owner is there. Still the missing variables are the two men that broke into the home. The reason the cop asked Gates to step outside the home was to separate him from potential danger (possibly unknown) inside the house. It seems protocal.

You're quite correct about the use of priors in the court of law but once again you missed the logical point that I was making which is that prior innocence does not predicate present guilt.
I hear what you're saying, but there are 2 faults with your logic, if you'll bear with me:
1) Crowley wrote false information in his report regarding the apparent race of the suspects; why did he do that?
2) A person's past history does not accurately reflect on present circumstance. For example, all first-time murders have never committed the crime before, therefor, their past history does not vindicate the present charge.
So often we hear about police arresting innocent people, while the real criminals are out on the streets. When people are arrested for such things as "insulting a police officer" (for questioning his actions), "resisting arrest" (because now that you have insulted the officer you are now being arrested), and "interfering with a police officer in the performance of his duty" (for filming him with a cell phone); I think it is safe to say that we are now living in a Police State.
Do you have any idea how many law enforcement encounters there are every day? Tens, maybe hundreds of thousands. And you think the few incidents you "hear" about indicate a police state? How ignorant.

For your information, we only hear about those "few incidents" because they happened to high profile individuals. However, countless people everyday are bullied, beaten, and tazed by our men in blue (oops I mean "black"). I'm sure that asking for an "officer's" name and badge number is grounds for being beaten, tazed, and arrested. Just try it and see.

I have spoken with and am friends with quite a few police officers and sheriff's deputies. None of them has ever beaten or tased me. Well, one did tase me but it was for a law enforcement demo and I volunteered. You know who should fear cops? Criminals.
If you can offer proof of all these other people (that evidently only you know of) that are being beaten, tased, and otherwise oppressed by the evil sunglasses, black uniform wearing, black car driving cops I would love to see it. The fact that the 911 caller never gave a description to Crowley and yet Crowley writes in the police report that she told him the suspects were "black males" with "backpacks" (which incidentally does not match her initial 911 description of one Hispanic male, one unknown, with suitcases) indicates that he was CHANGING THE NARRATIVE of what actually happened. The implication here is that he's lying to give himself just cause to arrest Gates.

As a group, we don't know how to interpret facts and separate it from fiction.
It is not completely beyond the realm of possibility that the poor woman who called the incident in has simply started recalling her story differently as the stakes rise in the investigation. Stress has a funny way of altering your memory by helping to recall certain details while also occasionally obscuring other details. That is why we usually simply go with a composite account from several different people. Different people give different stories. Sometime more than one story from each..
You have a valid point about that the possibility that the witness recalled the story differently.
But it does bring to question why the witness would change her description of, "one Hispanic male, one unknow, suitcases," (from the 911 call) to "black males with backpacks" (alleged interview with Crowley) mere minutes later.
After reading through the comments here one can discern two camps of thought:
1) Since the 911 caller did not mention race it means Gates injected race into the narrative first and is therefor the nominal "racist."
2) There were factual discrepancies between Crowley's police report and the caller's account, pointing to the possibility that Crowley's report is either inaccurate or patently false.

The majority of Americans are not racist. A minority getting elected as president is solid proof of this statement. As a non-racist white I think very low of racists. Probably as low as racists think of the people they are racists toward. Therefore, minorities that are quick to label someone a racist without solid proof should think twice. Being labeled a racists makes them as oppressed as blacks when racism was the norm.

The police made a mistake and unfortunately made things seem shady by dropping charges after they had arrested and booked him. I guess they dropped charges b/c they found out he was a famous scholar. But I wonder if they would have dropped the misconduct charges if he was just an average black dude... But this is nothing compared to the small Texas town stopping minorities and taking their money...
The fact is Sgt. Crowley shouldn't have arrested him. If you read his police report, you get a sense he arrested Gates just to embarrass and punish him for giving him lip. For an officer who taught classes on racial sensitivity, he performed poorly. He should have been professional and empathetic to the way Gates felt, whether Gates was wrong or not.
What I'd like to hear is the phone call Gates made when he picked up the phone to complain about Crowley just being there. Now that would be something.

He has a microphone near his own mouth, he's not putting it up to Gates's mouth to broadcast the shenanigans over the air, don't you know how microphones work?

3. charges were dropped because no law was broken.

2. how many police radios (probably with shoulder microphones) have you used? You have to put your mouth right on the damn thing or nobody can hear you. I know because I have used them.
3. Charges are dropped all the time because it isn't worth prosecuting because of the time spent vs. benefit gained. It doesn't mean an arrest was unjustified. It means the prosecutor didn't want to mess with it.

Officer Crowley, in his police report, claims he spoke with the 911 caller at the scene. But the witness "categorically" denies this occurred.
In addition, Crowley states that the witness told him she observed two black males with backpacks on the porch. If Whalen did not talk with Crowley at the scene, how could she tell him about the "two black males"? In addition, she clearly states in the 911 call that she could not identify the individual's race as black.
Whalen's attny now says she denied having contact with Crowley in one interview, in another interview from the USA Today it said "But Murphy, speaking on Whalen's behalf, says the only interaction between Whalen and Crowley occurred at the scene when she gestured to him and told him she was the 911 caller and he told her to stay where she was." SO which was it? Now who's lying? I think the scumbag attny who wants free press is lying.
In either case version crowley definitely wasn't told that two black men were seen entering the house. In his official report, wrote that he spoke with the caller and she told that the men are black. Clearly this wasn't sure of the race of man, saying he looks Hispanic but not sure, and the other she had no clue. Crowley made that shit up. Once he id Gates he should left, but he let his ego get in the way and may have falsely arrested Gates.

There are clear decisions of the Massachusetts courts holding that a person who berates an officer, even during an arrest, is not guilty of disorderly conduct. And yet that is exactly what Gates was arrested for.

Citizens absolutely have the right to request the name and badge number of an officer. It's a state law in Massachusetts. Gate provided his ID. Crowley never provided his at Gates' request.
You do not know that. Sgt. Crowley claims to have identified himself to Gates at least twice during their encounter. Considering the increasingly obvious unreliability (to put it mildly) of Henry Louis Gates' testimony I think that Sgt. Crowley should be considered innocent of failing or refusing to have provided his ID until proven guilty. If he was in uniform his badge number and name would have been right in front of Gates face anyway. Gates did say he got all in your face with Crowley right?

Actually, the officer DID give him his name. Officers are required to wear either a NAME tag or BADGE number. They are also given an ID card that they must present if a citizen wishes to see it. They are not required to wear both name and badge number . (although they can if they choose to.)
Gates was given the officers name. That is what he was entitled to by law. Either name OR number. Any further badgering for information is simply harassment.
Crowley did not give his full name. He simply said he was Seargent Crowley with the Cambridge Police. The uniform also only provides the last name. The reason that Gates followed Crowley outside was because Crowley said he'd give it to him outside.
you have a right to protest arrest, but as soon as he said anything that the statute covers as " 'tumultuous behavior,' which, while perhaps not physically violent, may nevertheless be characterized as involving riotous commotion and excessively unreasonable noise so as to constitute a public nuisance- he can be arrested for D.C. - and yes in his own home. the law is written horribly, and im sure thats why the charges were dropped.
the cell phone reception was bad and they are trained to talk very fast and efficiently. If someone breaks into my house, I WANT the person who's calling the police to SAY what they look like - I want as many details as possible.
The press has been very biased in their (initial) coverage of this. If we're going to have a "dialog on race" in this country let it be just that, "a discussion" not a lecture from one group to another.
All media says a lot stuff when all the facts are not present. The caller couldn't really give a good description and said so. One man said she had no idea, she just say him from behind. She also said two large men. From people who have met Gates as about 5'5" or 5'6" hardly big in size.Futhermore you can talk to an officer in any manner you want in your home. Look up laws on Disorderly conduct, the norm is being in a public place and one's home is not.
But let's be fair, event the media admits a left wing bias.
"She said two large men" First, the woman may be small. Two, anyone who's been to the theater, knows that an actor on a stage looks larger and it's difficult to judge height from a distance. Three, why does this point matter?
What happened in the home is still a matter of conjecture. And Gates was arrested when he continued his conduct - outdoors.
Ok I see..."left wing bias". Unless the woman was an elf 5'6" is not big. I suggest you go look at pic of gates in cuffed on his porch so you can see his frame. Also what happened in the home Crowley has not disputed. Gates was yelling and carrying on. Was in home until he got arrested and brought outside. Crowley kept asking Gates to come outside and Gates was refusing.
I'm not sure if the caller thought Gates or HIS driver was big or if she was merely relaying some of what the person she was calling for had said. I'm 6'2" and I've been fooled before by someone's height - in a few cases it was due to the person being on a "stage" in some cases it's due to what they're standing next to. Is Gates home an older home of a smaller frame? But really this whole point is trivial.
Crowley's ego got in the way. He didn't like being yelled at by Gates. So instead just simply making sure no crime was committed and keeping it moving, he wanted to make a point to Gates for the way Gates spoke to him.
How about we stick with what we know. I'm afraid you may be basing this upon your experience which if we're being honest is a variation on pre-judging.

In Detroit which is one of the most predominantly black cities in the USA, the black dispatchers identify race of potential perps to the black officers as a matter of procedure. So am I to assume all these blacks are racist? I hope not. When we roll up on a scene often there are numerous people and we need to know ASAP who the potential aggressor or criminal is, just in case violence becomes an issue. This is in FACT for the safety for all involved including the possible Perp.

I agree with those who say you need to get a profile. It's a best practices thing , like make, model and color on a stolen auto.
I would feel better about it if they just asked "complexion?" or "skin tone? I think that "white, Latin or black" is sort of a carry over from the past when we were a lot less diverse. Why not ask if Asian, Native American, Arabic etc?

You guys have to consider the situation in its entire format: Cop receives dispatch call off a possible "break in" of "two large" men. He arrives at the scene and comes to a man who identifies himself as owner of house with valid license. Okay...check, owner is there. Still the missing variables are the two men that broke into the home. The reason the cop asked Gates to step outside the home was to separate him from potential danger (possibly unknown) inside the house. It seems protocal.

1) Crowley wrote false information in his report regarding the apparent race of the suspects; why did he do that?
2) A person's past history does not accurately reflect on present circumstance. For example, all first-time murders have never committed the crime before, therefor, their past history does not vindicate the present charge.

When people are arrested for such things as "insulting a police officer" (for questioning his actions), "resisting arrest" (because now that you have insulted the officer you are now being arrested), and "interfering with a police officer in the performance of his duty" (for filming him with a cell phone); I think it is safe to say that we are now living in a Police State.

For your information, we only hear about those "few incidents" because they happened to high profile individuals. However, countless people everyday are bullied, beaten, and tazed by our men in blue (oops I mean "black"). Yes, our police now dress in black uniforms, drive black cars with blacked out windows, and wear dark sunglasses to conceal their identities. I'm sure that asking for an "officer's" name and badge number is grounds for being beaten, tazed, and arrested. Just try it and see.

One might call it "playing devils advocate". But believe what you wish. Most people do. I have a theory of what happened and it will be either proven or disproved. If it is disproved then I was wrong, and all 3 officers were complicit in a racially motivated arrest. If I am right it will show that a "holier than thou" new england intellectual overstepped his bounds and went through a humbling experience. I think the latter is more likely, but who knows? I will wait and see.

The fact that the 911 caller never gave a description to Crowley and yet Crowley writes in the police report that she told him the suspects were "black males" with "backpacks" (which incidentally does not match her initial 911 description of one Hispanic male, one unknown, with suitcases) indicates that he was CHANGING THE NARRATIVE of what actually happened. The implication here is that he's lying to give himself just cause to arrest Gates.

It is not completely beyond the realm of possibility that the poor woman who called the incident in has simply started recalling her story differently as the stakes rise in the investigation. Stress has a funny way of altering your memory by helping to recall certain details while also occasionally obscuring other details. That is why we usually simply go with a composite account from several different people. Different people give different stories. Sometime more than one story from each..

But it does bring to question why the witness would change her description of, "one Hispanic male, one unknow, suitcases," (from the 911 call) to "black males with backpacks" (alleged interview with Crowley) mere minutes later.

After reading through the comments here one can discern two camps of thought:
1) Since the 911 caller did not mention race it means Gates injected race into the narrative first and is therefor the nominal "racist."
2) There were factual discrepancies between Crowley's police report and the caller's account, pointing to the possibility that Crowley's report is either inaccurate or patently false.

I would be willing to bet Gates was acting beligerently. Crowley may have been excessive in making the arrest but I'm sure Gates must have been very beligerent in behavior for this to escalate to an arrest/

Probably as low as racists think of the people they are racists toward. Therefore, minorities that are quick to label someone a racist without solid proof should think twice. The fact is Sgt. Crowley shouldn't have arrested him. If you read his police report, you get a sense he arrested Gates just to embarrass and punish him for giving him lip. For an officer who taught classes on racial sensitivity, he performed poorly. He should have been professional and empathetic to the way Gates felt, whether Gates was wrong or not.

1. crowley falsified his report. the witness never ID race at any time. no one can vouch that crowley ever spoke with the witness. finally, there was another officer's report that spoke with the witness (she never mentioned race). the other officer and the witness prove crowley is a liar.
2. microphones do not filter sounds. yelling would've been much louder. if there was talking int he background, it would be muffled like it was.
3. charges were dropped because no law was broken.

1. lawyer of witness has refuted that statement. She spoke to him. And it is in his report. Unless you have another witness, the only record we have is the official report.
2. They are designed so that in normal environments only the officers voice will be picked up in order to keep radio traffic intelligible. That is why he went outside. Have you ever used one? I have.

Officer Crowley, in his police report, claims he spoke with the 911 caller at the scene. But the witness "categorically" denies this occurred.
In addition, Crowley states that the witness told him she observed two black males with backpacks on the porch. If Whalen did not talk with Crowley at the scene, how could she tell him about the "two black males"? In addition, she clearly states in the 911 call that she could not identify the individual's race as black.

In either case version crowley definitely wasn't told that two black men were seen entering the house. In his official report, wrote that he spoke with the caller and she told that the men are black. Clearly this wasn't sure of the race of man, saying he looks Hispanic but not sure, and the other she had no clue. Crowley made that shit up. Sounds like gates is a trouble maker . . they keep calling crowley but he's too busy to respond. The other officer also asks for a wagon so they can take gates into custody. It has nothing to do with simply berating an officer and everything to do with obstruction of justice. The cop is there to investigate a possible crime and gates was obstructing that investigation. Pure and simple. The only racist one at the scene was gates, if Crowley was black he would have co-operated fully.

There are clear decisions of the Massachusetts courts holding that a person who berates an officer, even during an arrest, is not guilty of disorderly conduct. And yet that is exactly what Gates was arrested for.

Notice how different the facts of this story are from the original version we heard in the media.
"Black Harvard professor a target of racial profiling" has turned into "loudmouth jerk arrested for badgering police officer at potential crime scene".
This is because today we have access to all of the facts. It makes me wonder if we really have true accounts of past news stories.

Fools, even if the 911 caller did not mention race, it only makes Gates argument stronger. Read the police report; the officer, himself, wrote two black men. Where did he get this information? Also, officers are trained to collect evidence. If Gates, was being disorderly, why wasn't it captured on the radio? I take note of the fact that Sgt. Crowley refers to Gates as "the gentleman" at the 4:20 mark or so, and calmly notes that he is not cooperating. Referring to an uncooperative African American "suspect" as a "gentleman" is hardly the kind of description that one would expect from the kind of racist "rogue policeman" that Dr. Henry Louis Gates Jr. has publicly and indeed *nationally* slandered Sgt James Crowley as being. . . The cops really could have just left once they verified that he lived there. No need for arrest. Gates' disposition is understood as who wants to be questioned at your own house.

To be the first person to throw race into the matter after no specific race was stated, what would have Gates done if the arresting officer was Spanish? Ask for his green card? The cop did his job, plain and simple. Not only does the Cambridge police department deserve the apology, but every police department in the united states deserves an apology. The president didnt only question one cop about his ethic, it was police officers country wide which were put to question.

The cop was being falsely accused of racism in front of other police officers. And it was being done in a loud manner. All while the officer was attempting to protect the mans property from potential theft. Gates had no reason to demand name and badge number from the officer when he was simply doing his job.
I think that defines disorderly conduct at least. Slander and harassment at worst.

Citizens absolutely have the right to request the name and badge number of an officer. It's a state law in Massachusetts. Gate provided his ID. Crowley never provided his at Gates' request.

You do not know that. Sgt. Crowley claims to have identified himself to Gates at least twice during their encounter. Considering the increasingly obvious unreliability (to put it mildly) of Henry Louis Gates' testimony I think that Sgt. Crowley should be considered innocent of failing or refusing to have provided his ID until proven guilty. If he was in uniform his badge number and name would have been right in front of Gates face anyway. Gates did say he got all in your face with Crowley right?

Actually, the officer DID give him his name. Officers are required to wear either a NAME tag or BADGE number. They are also given an ID card that they must present if a citizen wishes to see it. They are not required to wear both name and badge number . (although they can if they choose to.)
Gates was given the officers name. That is what he was entitled to by law. Either name OR number. Any further badgering for information is simply harassment.

Crowley did not give his full name. He simply said he was Seargent Crowley with the Cambridge Police. The uniform also only provides the last name. The reason that Gates followed Crowley outside was because Crowley said he'd give it to him outside.

you have a right to protest arrest, but as soon as he said anything that the statute covers as " 'tumultuous behavior,' which, while perhaps not physically violent, may nevertheless be characterized as involving riotous commotion and excessively unreasonable noise so as to constitute a public nuisance- he can be arrested for D.C. - and yes in his own home. the law is written horribly, and im sure thats why the charges were dropped.

the cell phone reception was bad and they are trained to talk very fast and efficiently. It's for the purpose of getting officers on the scene as quickly as possible with the most relevant information. i agree, he does sound like a jerk, but that's what they are trained to do to extract as much useful information as possible :)

She did mention that she was walking by when the event was talking place. The woman did nothing wrong, but you must think the Cops are gods and don't fuck up on their jobs like Crowley did. The police seem not to understand what civil rights are.
If Gates feels hes civil rights were violated, then it is not for the police to deny him the right to complain. Making repeted statements that race is not involved, is an inappropiate response to concerns that civil rights were raised.
It shows the police are pre judging. No due process here. Arrest appears to be intimidation in response complaint.

The 911 tape was brought up by the media as "racial profiling" which is why it's become an issue. I think the issue is absurd.
If someone breaks into my house, I WANT the person who's calling the police to SAY what they look like - I want as many details as possible.
The press has been very biased in their (initial) coverage of this. If we're going to have a "dialog on race" in this country let it be just that, "a discussion" not a lecture from one group to another.

All media says a lot stuff when all the facts are not present. The caller couldn't really give a good description and said so. One man said she had no idea, she just say him from behind. She also said two large men. From people who have met Gates as about 5'5" or 5'6" hardly big in size.Futhermore you can talk to an officer in any manner you want in your home. Look up laws on Disorderly conduct, the norm is being in a public place and one's home is not.

"She said two large men" First, the woman may be small. Two, anyone who's been to the theater, knows that an actor on a stage looks larger and it's difficult to judge height from a distance. Three, why does this point matter?
What happened in the home is still a matter of conjecture. And Gates was arrested when he continued his conduct - outdoors.
Finally, Gates clearly has ego and power issues.

Also what happened in the home Crowley has not disputed. Gates was yelling and carrying on. Was in home until he got arrested and brought outside. Crowley kept asking Gates to come outside and Gates was refusing.

I'm not sure if the caller thought Gates or HIS driver was big or if she was merely relaying some of what the person she was calling for had said. I'm 6'2" and I've been fooled before by someone's height - in a few cases it was due to the person being on a "stage" in some cases it's due to what they're standing next to. Is Gates home an older home of a smaller frame? But really this whole point is trivial.
