The police and security were very polite and professional in every instance. Trespassing is an offence (provincial statute). When you commit an offence, the police have lawful authority to establish the identity of the person committing the offence - which is you. You could easily have been arrested.

Is there a common footpath to the front entrance, is this a hotel open for business, etc. I cannot be cited for tresspassing at a mcdonald's unless the manager, owner, or a store representative has asked me to leave. These kids walked off the property after they were told to leave. The cop took this into account.

They want to know your names because you're trespassing on private property. They have the right to take your names since they're representing the owners of the property. If you were on the street it's okay but the hotel isn't public property. He was being very courteous and explained exactly why you could not walk on that particular property. First of all, the Hotel parking lot most definitely is a public space - even though it's privately owned. Secondly, just because you're on private property doesn't mean you're trespassing. In order for it to be trespassing, you must knowingly violate some barrier - e.g. climb a fence, ignore a "keep out" sign, open and walk through a closed gate, etc.
The Police Officer can charge these individuals under the Ontario Trespass to Property Act under every subsection under 2(a)(1).Furthermore, by being not producing ID to the Police Officer when requested, all the Officer would have to do is begin to write them $65 TPA tickets and if they fail to provide ID again, they can be arrested for Obstruction of Justice and held indefinetly until identity is confirmed. The Police Officer can charge these individuals under the Ontario Trespass to Property Act under every subsection under 2(a)(1).Furthermore, by being not producing ID to the Police Officer when requested, all the Officer would have to do is begin to write them $65 TPA tickets and if they fail to provide ID again, they can be arrested for Obstruction of Justice and held indefinetly until identity is confirmed. Hope that clarifies things for all those who THINK they know the law..and DON'T!

Youre right...You don't have to have produce ID when asked by Security. BUT, Security Guards in Ontario most certainly do have the powers of arrest and should you happen to find yourself in a situation where you are arrested by a Guard, you realize how real the arrest procedures are and how easily available your ID becomes when handcuff restraints are being placed on you! The Trespass To Property Act is enforced by licenced Security Guards, Police Officers and property owners.

in this scenario the two idiots were detained by the officer and at that point they are not free to leave. This is an investigative contact, no "probable cause" is required. Once the officer asks fro ID they are required by law to provide it on demand. The term "probable cause" gets thrown around by those that really haveno idea what it actually means. If you are detained and refuse to ID yourself...you will...or should be arrested.

an officer approaching you is not being detained. if the officer was detaining them then they wouldn't have gone anywhere. he was trying to convince them they should give their names. he had nothing to back it up. he knew it and they knew it and they accepted their option to leave the property. I live in that jurisdiction. I know how it works. Probable cause means they have to have a REASON. Gut feelings or spider sense doesn't count. you know cops lie to get what they want, right?

ACTUALLY, under the Ontario Trespass to Property Act, while on private property you can be asked at any time for ID or directed to leave by the property owner or a representative of the property owner. However once a peace officer asks you for ID while you are TRESPASSING, you are obligated to provide it. These two came extremely close to getting cuffed and charged with trespassing.
