california in that case has based everything under the color of law. I think this lawyer has forgot mere act and statutes cannot supersede common law. But if you get married via a license you have given up more rights for benefits. Only the two people married and the family have to acknowledge the marriage. who cares about the made up license laws. not me.

Actually statutes can and regularly do supercede common law. California is no different and has set forth in the Family Code that there is no common law marriage.
