Yes indeed :D. This defense is weak. This is good to protect from bugs, not humans. In fact as Chepsy said, it could only provoke attacker, and you do not want to do that(not all attackers are stupid / emotional).

To answer your questions though; I have studied much into criminal profiling. From my education I learned that this is a common tactic that serial rapists and serial kidnappers use to avoid harsher punishment for when they are caught. There is a difference of 15 years in a prison and life in prison on if a weapon or not was used. At least in the US this is how the law is.
