you can tell it was a seperate window because when you try to take a screen shot and you have the start menu open it only takes a screenshot of the start menu and not the desktop, try it

and you can also tell cuz if you put the taskbar at the op of the screen and open the star menu the little icon thing overlaps the taskbar and the top of the start menu gets covered up

Through a software I wrote called "ThinkArrow" (You can see it in the background). It can react to the tilt of a thinkpad laptop and move the top-most window according to the position of your thinkpad. And if we make the start menu thea top-most window, and we tilt the thinkpad to the right, the start menu "falls" down to the right.
