I find it very interesting how many of the comments here thinks that the BMW is partially at fault... I politely disagree... If the VW did not try to drive between the BUS and the BMW, then this will never happen... It doesn't matter what the BMW has done or if the BMW is trying to change lanes or whatever... the VW should not be there in the first place... If you think the Gold is the victim, think about that: If the Golf did not cut lane in such bad manners, nothing would have happened at all.

If you do something seriously wrong, it is only fair for you to expect something seriously bad to happen.

Of course, legally speaking, the BMW can also be charged of reckless driving and for not having tried his best to prevent accident. But in his defense, he could not be blamed for not expecting a car being there.

I would have to say that the GTI is at fault mostly. The GTI driver changed land when he is not supposed to, that can be accuse as unsafe land change. Plus in legal perspective, the GTI technically did not even change lane completely. Please note that there are only 2 lanes, GTI was not able to change lane "completely", so it is technically not in any lane (or called "failed to stay in lane")

However, the BMW driver is also partially at fault since he did not try his "best" to avoid accident.

yeah, I don't see how this is the BMW's fault, clearly the bus is in the VW's lane, and that asshole decides his important enough to drive halfway into the BMW's lane to pass. WITHOUT signaling until he was about to cut off the BMW nonetheless. If the VW wasn't there, the BMW's lane change would be perfectly fine, leaving more than enough room for the bus. IMO, VW totally deserved it
