  • I do have a question, though. If this is all true, why then, was this proposition allowed on the ballot in the first place? Shouldn't we also be pursuing legislation that doesn't allow such things to come to a vote, too?

  • I can't find the articles that would answer your question, but from my memory, the revision argument was brought to the judges immediately after Proposition 8 was placed on the November 2008 ballot, and the judges dismissed the argument at that time but left a window open for the argument to be brought up again after the election. Apparently there is a strong precedence to dismiss revision arguments before the election, maybe to allow voters to strike these initiatives down themselves first.
