The constitution is what's called "the supreme law of the land". There is no law the government can pass that over rules it. Any law they pass that does, should be considered what it is, null and void.
If they wanted to pass such a law, it would require a constitutional convention. Until that day comes, if anyone attempts to steal from me in an emergency, they are no longer a government official, they are a criminal.

I should have added that the Oath of Service also includes active duty military. We were REQUIRED to take that oath to serve, but most of us were honored to. My father, who had worked his way up to Commander from E1, administered the Oath to me. I understand that First Responders, PD, S.O. and so on, also take a similar oath. Another question: Could this gov't, including Congress, possibly be MORE anti-Constitution, pass worse unconstitutional laws? Even the SCOTUS has betrayed their oaths!

If the Constitution is suspended, the document from which the gov't gets its authority no longer applies. Use the military against citizens then, and whoever has the firepower is "in charge" - that's what martial law IS: rule by military aka "a military coup." So, ex-military: Does a military takeover driven by officials who stole elections or lied to win qualify them as "enemies both foreign AND DOMESTIC"? If so, what does your sacred honor given in sworn oath require?

I like Bill a little less now. Our rights come from God not the courts. The supreme court interprets laws it does not uphold the constitution. If it did there would be no need for supreme court rulings as unconstitutional laws would never get passed in the first place. Also just because there is precedent doesn't make it legal. Government infriges on our rights all the time, it's only when someone says something that we hear about it and something gets done about it. Educate yourself better.

I watched the original airing of Mr Rhodes on B-O and I recall B-O stating that a "natural disaster" was sufficient cause to suspend everyone's rights. He tried to further defend the action of disarming citizens by citing the lawlessness that ensued the hurricane. So there's some BS that I wish to expose here - the argument was not about martial law, it was about disarming citizens during katrina.
That interview with Rhodes and OReilly was the last time I ever watched the show...

BUT, the ONLY way that courts can overrule the legislation is IF the bill (or state of emergency or ect..) already DOES violate the Constitution.
As citizens we have the right to challenge any laws we feel are Constitutional, and THEN let it go to court.

I just hate all TV personalities, they have no ideals of their own, they only spout off what people pay them to say in order to stir up angst between political parties.

The constitution specifically prohibits such a law.
The constitution is what's called "the supreme law of the land". There is no law the government can pass that over rules it. Any law they pass that does, should be considered what it is, null and void.
If they wanted to pass such a law, it would require a constitutional convention. Until that day comes, if anyone attempts to steal from me in an emergency, they are no longer a government official, they are a criminal.
