That is not really accurate. If your son, or father sold your land without the binding authority to do so I think you would consider the 'sale' voidable. You see, Traditional English practice was to deal with Males. But, many Natives are Matrilineal. There are a host of other reasons that might render a westernized conception of 'sale' voidable. The Natives might have understood the agreement to mean 'sharing'. In this case there would be no meeting of the minds, and thus no sale contract.

Thus, it is the community that can bind the community to a "sale" (though what "sale" means is debatable too!). Who has authority to bind the community in an instrument (sale) which the Aboriginal people had no conception of - or a conception that was very different from the Western one?

Good points. I think that there is a lot of misinformation and latent racism in the Non-Native community. I don't understand why Non-Natives find it so hard to conceive of a people who don't necessarily share all of the exact same land-rights values as they do. Land rights very from country to country and depend on unique histories and cultures. Canada needs to re-write land law to incorporate natives concepts into our rules, so that the law truly reflects those who follow it.

The thing is crown land resides on Six Nations territory and the Whitefish ruling in november 2007 ruled that further breaches by the crown will be detered; and the First Nation will get land back, and have loss of land use, currency rates,monies owed ... etc factored into a settlement as well!Have a nice day!

I hear of some groups in the eastern provinces organizing forces to start a hostile take back of the land and uttering threats such as 'we are getting ready to take back what is ours with any force needed' the thing is, most people maybe want this to see this put to an end and it would be over quick for the natives.
