Moved as I am by this movie, I would keep the death penalty for certain kinds of murder such as those premeditated with no mitigating circumstances, and serial murders by the technically sane. One cannot expect a court not to find the accused guilty if he goes to such pains as this to fake his guilt, and if the local law requires the death penalty, the court cannot be blamed any more than a train driver when a suicide leaps onto the track. But if there is reasonable doubt, you're off the hook.
We now have DNA to help the thousands that were wrongly convicted. Our justice system jumps to thier own conclusions no matter how much they have for evidence. Your GUILTY til INNOCENT!

They were trying to prove that the system is flawed; "almost murder doesn't count" is a line in the movie, and nobody's willing to do a retrial when the defendant is dead, so the video was the only way they could do show the world that mistakes DID happen. The dead lady had leukemia, and Gale's life had fallen apart. Neither of them had anything to live for, so they plotted this out to prove a point and do something worthwhile

@Laura72000 Sadly the failure is with David Gale. The only thing he proved is that, if you want to executed of a crime you didn't commit, set yourself up and don't try to defend yourself. The fault isn't with the police, the forensic scientists, or the DA, it's with Gale.
Roger Ebert puts it best, "but let it be said this movie is about as corrupt, intellectually bankrupt and morally dishonest as it could possibly be" and "The last shot made me want to throw something at the screen..."

Can you imagine the absolute dedication it would take to do that? To literally willingly be executed for your beliefs? That kind of dedication is very rare, even during a war.
He didn' t kill her. She agreed to die that way because she knew she would die anyway (she had a leukemia), and David was there and put fingerprints on the bag so he would be sentenced to death.

This is most definitely one of my favorite Keven Spacey films. Movies that focus entirely on plot are becoming more and more rare recently, unfortunately. To anyone who hasn't seen this movie before, I recommend it.

The ending ruined the entire movie with the last piece of evidence given. His goal of showing the crooked system would have been destroyed by the fact that he in fact did lock the hand cuffs, subsequently killing the woman. It would show that the correct man was killed and would only strengthen capital punishment advocates.
It actually amazes me how many people get this ending wrong. the last tape was given to Bloom to provide relief from her guilt of not being able to save him when she discovered Gale did not commit the murder. It was the "key to her freedom".
If you notice it is also clearly written on the video tape "Off the Record" and as Bloom stated previously in the film, when something is told to her off the record, she takes it to her grave. That is why Gale chose her. So the tape will never be released and as far as Gale's quest to prove the death penalty is unreliable, his goal was reached. The trailer also states it's a movie about "how far people will go in the name of a cause. Gale went to his death.
Gale did not lock the handcuffs - Constance swallows the key to the handcuffs and locks them herself. Therefore Gale (and Dusty) only technically assisted in her suicide.
Those fuckers rotting behind bars is more suffering than a quick easy death. They should rot away. Some should have very painful deaths though

@mtavares92 , don't judge, may be he was innocent. we all don't know about this case. even if he did kill her, why not life in prison rather than killing him. this is like the barbaric days of eye for an eye, and tooths for a tooth.

Actually I am openly against the death penalty. I think that the only reason this punishment is still being enforced is for the same way as abortion: deep down, people know the real moral truth, of what should be done, but they find it hard to work enough to make things right, so they tell a lie to themselves and to others.. that some human beings deserve to die, and that a fetus is not life worthy or human, just so no more complications arise..

@natidani2000 - the point is that he DIDN'T killer her, the reason she is seeing the tape is so that SHE knows it's ok, she didn't fail; he's letting her know he wanted to be caught to prove the point. Anyone who watched the film in full will see this is more than clear :)

They were trying to prove that the system is flawed; "almost murder doesn't count" is a line in the movie, and nobody's willing to do a retrial when the defendant is dead, so the video was the only way they could do show the world that mistakes DID happen. The dead lady had leukemia, and Gale's life had fallen apart. Neither of them had anything to live for, so they plotted this out to prove a point and do something worthwhile

@RRainey20 thats what we dont know. its the idea of the free will to the publc. we arent sure if gale did in fact know he was going to die or whether he thought he was going to be sabes at last. we dont know if wright betrayed him because of his relationship to harring.

I accually understood how it would end very early in the movie, dont know why. On the dvd it say's "mind blowing conclusion". that gave it away i guess. Loved it thou, its a Great movie. Saw it after hearing the soundtrack in the "munich" trailer.

@Laura72000 Sadly the failure is with David Gale. The only thing he proved is that, if you want to executed of a crime you didn't commit, set yourself up and don't try to defend yourself. The fault isn't with the police, the forensic scientists, or the DA, it's with Gale.
Roger Ebert puts it best, "but let it be said this movie is about as corrupt, intellectually bankrupt and morally dishonest as it could possibly be" and "The last shot made me want to throw something at the screen..."

@jannecechmanek He hired a lawyer to defend him (albeit badly), and a duo of reporters to get his story out; in addition, he claimed to be innocent (to the reporters). What more should he have done to defend himself?

Can you imagine the absolute dedication it would take to do that? To literally willingly be executed for your beliefs? That kind of dedication is very rare, even during a war.

He didn' t kill her. She agreed to die that way because she knew she would die anyway (she had a leukemia), and David was there and put fingerprints on the bag so he would be sentenced to death.
Remember he's an anti-death penalty activist; by doing this with Constance he would be able to prove that sometimes innocent people get killed. Constance and him did it together.

No he did not commit the murder, he was here when she killed herself and we see him on the video because he's putting his fingerprints on the bag to be sure that he will be accused of the murder and that he will be sentenced to death (sorry for my english I'm french =\). This is the key of Bitsey's freedom because it shows that Gale didn't want to be saved and that this is not her fault if he's dead now, and that if was kind of planned. I hope you understood me ^^

@fatheadbree Oh! yes it is, I think it is the reward he got from the media. I d worked for the newspaper for years but I missed this point as no any interviewees were paid for the interview. We just sometimes gave them some gifts. (yes, not to everyone).

This is most definitely one of my favorite Keven Spacey films. Movies that focus entirely on plot are becoming more and more rare recently, unfortunately. To anyone who hasn't seen this movie before, I recommend it.

The ending ruined the entire movie with the last piece of evidence given. His goal of showing the crooked system would have been destroyed by the fact that he in fact did lock the hand cuffs, subsequently killing the woman. It would show that the correct man was killed and would only strengthen capital punishment advocates.

It actually amazes me how many people get this ending wrong. the last tape was given to Bloom to provide relief from her guilt of not being able to save him when she discovered Gale did not commit the murder. It was the "key to her freedom".

If you notice it is also clearly written on the video tape "Off the Record" and as Bloom stated previously in the film, when something is told to her off the record, she takes it to her grave. That is why Gale chose her. So the tape will never be released and as far as Gale's quest to prove the death penalty is unreliable, his goal was reached. The trailer also states it's a movie about "how far people will go in the name of a cause. Gale went to his death.

Gale did not lock the handcuffs - Constance swallows the key to the handcuffs and locks them herself. Therefore Gale (and Dusty) only technically assisted in her suicide.
