    My point is that the Constitution of the US makes America a republic. The idea was that the people would elect some wise leaders to represent them in government. It was one way they sought to prevent large numbers of people voting to do things bad for the country. Like socialism. that was the plan anyway.

    Remember the Repeal of Prohibition in the 1930's? The only way to repeal Prohibition that was imposed by a minority of Bible punchers who believed the U.S. was a "republic" was done by popular vote. The majority kicked the minority in the rear.

    In both cases, the majority ruled by voting. The majority votes and determines what laws, rights etc the people have in the U.S.

  • The courts merely interpret the constitution .... They can only decide what is constitutional for those who are subjects of the US.. (US Citizens) .. Note the "US" is a non-descriptive word, and identifies the Federal Territory located in DC at Article 1, Section 8, Cl. 17.

  • Alright, I have read almost every comment left on these videos and I have seen a lot of people quoting the constitution and the Federalist Papers, and I have seen a lot of other people quoting The Supreme Court. So far, it seems like much ado about nothing. Simply put the Bill of Rights is a series of guarantees to the states that their sovereignty and the rights of their citizens. It's time the Federal Government remembered that.

  • The 10th amendment IN the Bill of Rights states that laws not covered by the feds are then decided by the states. Dig a little deeper when reading the Bill of Rights.

    It has nothing to do with laws, as laws are merely the means of implementing the legitimate powers delegated by the Constitution.

The tenth amendment is part of the Constitution, so if it is nonapplicable, don't the parts of it (such as the tenth amendment) become nonapplicable? Or is only the parts of the Constitution that you like applicable?

    I'm not sure I get your point. The Constitution, as a delegation of limited powers from the States, is the basis of the authority of the US federal government. The 10th Amendment is applicable. But you do not seem to understand what the 10th Amendment says.

  • @benjamindees Article 6 is known as the Supremacy Clause, which states the federal law is the top law of the land. Look it up and let me know if you don't understand its meaning.

    The Second Amendment always applied to the citizens, and the states are saying you cannot take that right away.

  • That's correct, Madison and Jefferson were more in favor of state's rights and other founding fathers were more in favor of federal rights. A compromise was worked out where states made laws that weren't covered by the federal gov't. The 10th amendment is all over this.

If the federal government acts in a way that makes the constitution worthless, than it is a lesser offence for a state to make a logical conclusion that they are no longer bound by the constitution either. Such an action is not unreasonable or underhanded as Glen Beck suggests.

Don't states send members to the federal gov't to make laws? I'll bet your state has 2 senators and at least 1 house member to make laws.   • I'm confused. The second amendment has the right to bear arms under the context of a well regulated militia being necessary to the security of a free State. It doesn't protect the right to own an assault weapon. In all honesty, where do you draw the line? Do you think people should be able to say, build their own tomahawk missile? Or possibly a nuclear device? People in this country have the means and the brainpower (and some, the desire) for both, so does the second amendment allow for this?
